Abstract

Wem gehört das Wissen? Zuallererst dem Schöpfer geistigen Eigentums, dem Urheber. Veröffentlicht der Urheber sein Wissen als Werk auf dem Markt, so wird es zur Ware und zugleich zum Allgemeingut. Denn mit der Veröffentlichung von Wissen besteht ein öffentliches Interesse, sich damit ungehindert auseinanderzusetzen, um neues Wissen zu erzeugen. Wie sind die Eigentumsund Nutzungsrechte dabei zuzuordnen und zu wahren? Hegels Szenario "Wenn ich z.B. eine Windmühle baue, so habe ich die Luft nicht formiert, aber ich mache eine Form zur Benutzung der Luft, die nur deswegen nicht genommen werden darf, weil ich sie selbst nicht formiert habe."1 erklärt sehr bildhaft das Wechselspiel von Gebrauch und Besitz des eigenen und fremden Eigentums. Der Staat begegnet diesem Bedürfnis nach Zugang durch das Grundrecht der Informationsfreiheit, das Recht eines jeden Bürgers, sich ungehindert und unabhängig von seiner sozialen Stellung aus veröffentlichten Quellen zu informieren. Es stellt ein fundamentales Menschenrecht dar. In mehreren internationalen Abkommen haben sich Staaten zu ihrer Einhaltung verpflichtet.Die Bundesrepublik Deutschland hat dieses Grundrecht in Art. 5 ihrer Verfassung niedergeschrieben. Urheberrechtliches Schaffen basiert auf der Ausübung der Informationsfreiheit. Ohne Auseinandersetzung mit vorhandenem geistigem Schaffen wäre eine Weiterentwicklung in Wissenschaft, Kunst und Literatur nicht möglich. Freie Information sichert Fortschritt, qualifizierte Arbeitskräfte und damit Wirtschaftsstandorte.
