Abstract
Die Patentinformation erfüllt vorrangig die Aufgabe, unter Anwendung geeigneter Mittel, Methoden und Organisationsformen Informationen aus Patentschriften zu erfassen, auszuwerten, zu speichern, zu recherchieren, bereitzustellen und zu bewerten. Neben den Patentschriften als wichtigste Dokumente des gewerblichen Rechtsschutzes berücksichtigt die Patentinformation im weiteren Sinne auch Marken, Geschmacksmuster und andere gewerbliche Schutzrechte. Patentschriften sind von nationalen, regionalen und internationalen Patentämtern veröffentlichte Dokumente, die vorschriftsgemäße Informationen über Erfindungen enthalten, für die ein Patent angestrebt bzw erteilt wurde. Gebrauchsmusterschriften sind Patentschriften besonderer Art. Ein Patent verleiht dem Inhaber das ausschließliche, aber zeitlich und territorial begrenzte Benutzungsrecht an seiner Erfindung. Die Patenterteilung belohnt den Forschungs- und Entwicklungsaufwand beim Entstehen von Erfindungen und ermöglicht dem Inhaber eine Monopolstellung zur Verwertung seiner patentierten Erzeugnisse und Verfahren. Das bedeutet Sicherheit und Wettbewerbsvorsprung. Nach Ablauf der Schutzdauer kann auch die Allgemeinheit die Erfindung nutzen. Patentfähig ist die Erfindung, wenn sie technisch, neu, auf einer erfinderischen Tätigkeit beruhend und gewerblich anwendbar ist. Ca. 1,2 Millionen Patentschriften, denen etwa eine 0,75 Millionen Erfindungen zugrunde liegen, bilden den jährlichen Zugang für die Systeme der Patentinformation. Hinzu kommen noch die Gebrauchsmusterschriften; sie vergrößern diesen Zugang wesentlich, wenn auch die einst große Anzahl der japanischen Gebrauchsmusteranmeldungen nach Wegfall der Sachprüfung im Jahre 1983 erheblich geschrumpft ist. Allein in der Datenbank INPADOC waren Anfang 2004 mehr als 28 Millionen Patentschriften und 2 Millionen Gebrauchsmusterschriften gespeichert.
Da nur 10 bis 30% der Erfindungen in anderen Quellen als in Patentschriften beschrieben werden, ist die Patentinformation für die Kenntnis des Weltstandes der Technik und seiner wirtschaftlichen Verwertungsbedingungen unersetzlich. Die aktuelle und vollständige Information über den Stand der Technik verdanken Wissenschaft, Technik und Wirtschaft dem Grundprinzip des Patentwesens: Das Patentwesen verhindert die Geheimhaltung technischen Wissens, indem es den Erfinder und Patentinhaber für die Preisgabe der Information rechtlich schützt, d.h. es verknüpft Technik und Recht aufwirtschaftsstimulierende Weise. Der daraus resultierende Doppelcharakter einer Patentschrift als Technik- und Rechtsdokument ist keine lästige Erschwernis, sondern ein zu nutzender Vorzug. Noch führt die ungenügende Kenntnis der Patentinformation zu unnötiger Doppelforschung und zu zurückgewiesenen Patentanmeldungen. Ein Drittel der Forschung und der Patentanmeldungen erfolgt nutzlos. Die Patentinformation kann - gestützt auf Patentdatenbanken und Volltextarchive in weltweiten und lokalen Informationsnetzen - einen wachsenden Beitrag an der Entwicklung und Markteinführung innovativer Produkte und Verfahren leisten.
