Abstract
Die Bundesregierung - insbesondere das Bundesministerium für Bildung und Forschung - möchte sicherstellen, dass in deutschen Universitäten und Forschungseinrichtungen moderne Technologien umfassend genutzt werden können, um bestmögliche Arbeitsbedingungen zu schaffen. Dazu hat sie im Entwurf eines Zweiten Gesetzes zur Regelung des Urheberrechts in der Informationsgesellschaft unter anderem die Schaffung zweier Urheberrechtsschranken (§§ 52b und 53a UrhG-E) vorgesehen. Diese sollen es Bibliotheken ermöglichen, Kopien in Anwendung des § 53 UrhG direkt dem Besteller grundsätzlich in jeglicher Lieferform zuzusenden (§ 53a) sowie Bibliotheken, Museen und Archiven erlauben, in ihren Einrichtungen elektronische Leseterminals vorzuhalten, an denen Nutzer auf digitale Kopien ihrer Bestände, z.B. von Büchern und anderen Printbeständen, zugreifen können (§ 52b). Börsenverein und Bibliotheksverband sind sich darüber einig, dass wissenschaftliche Bibliotheken eine wichtige gesellschaftliche Aufgabe bei der Zugänglichkeit von Informationen jeglicher Art wahrnehmen. Zugleich wissen sie um den hohen Aufwand, der insbesondere mit der Herstellung hochwertiger Zeitschriften und wissenschaftlicher Lehrbücher verbunden ist. Für die Finanzierung wissenschaftlicher Zeitschriften ist derzeit kein effizientes Geschäftsmodell als Ersatz für die Subskription in Sicht. Die Bibliotheken berücksichtigen diese Situation, indem sie gesetzliche Ausnahmeregelungen in angemessener Weise anwenden. Das Bundesministerium für Bildung und Forschung hat beide Interessenverbände aufgefordert, Vorschläge für die Ausgestaltung der o.g. gesetzlichen Regelungen zu unterbreiten. Die Verbände kommen dieser Aufforderung mit ihrer gemeinsamen Stellungnahme nach.
