Der Konflikt liegt darin, dass einerseits der Gesetzgeber für die Rahmenbedingungen sorgen muss, aber andererseits die Forderung nach mehr Freiheit bei der Umsetzung von sozialen, wirtschaftlichen und technischen Innovationen gefordert wird. In diesem Buch nehmen 41 Experten Stellung zu den drei Teilen "Ordnungsstrategien", "Regulierungsstrategien" "Rechtsrahmen und Innovation". Der erste Teil umfasst neun Beiträge und behandelt eher die technischen Medienaspekte. Zu nennen wären hier beispielsweise "Strategische Aspekte der Frequenzregulierung" (Matthias Kurth) oder "Der Aufbau von Breitbandinfrastrukturen im internationalen Vergleich" (Dieter Elixmann; Karl-Heinz Neumann). Der zweite Teil umfasst acht Beiträge und behandelt Themen wie "Broadcasting supervision" oder "Governance". Hier geht es unter anderem um "Rundfunkaufsicht: Ordnungsstrukturen im digitalen Zeitalter" (Klaus Kamps) oder um "Zukunftsmärkte und Kultur: Der Welthandel und die UNESCO-Konvention zum Schutz der kulturellen Vielfalt" (Verena Metze-Mangold). Der dritte Teil bietet insgesamt 13 Beiträge und stellt in erster Linie juristische Fragestellungen in den Mittelpunkt. Hier wären zu erwähnen" Urheberrecht und Innovation: Basket Two and Beyond" (Brigitte Zypries), "Urheberrecht und Vertragsfreiheit: Kritische Überlegungen am Beispiel der Verwendungsbeschränkung im IT-Bereich" (Thomas Hoeren), "Datenschutz bei RFID und Ubiquitous Computing" (Hansjürgen Garstka) oder "Jugendschutz: Zwischen freiwilliger Selbstblockade und unkontrollierter Selbstkontrolle" (Karsten Altenhain). Zu den wohl bekanntesten Experten zählen neben Bundesjustizministerin Brigitte Zypries und Hansjürgen Garstka, Vorstandsvorsitzender der Europäischen Akademie für Informationsfreiheit und Datenschutz, und Verena Metze-Mangold, Vizepräsidentin der Deutschen UNESCO-Kommission, auch Jürgen Bullinger, Präsident der Fraunhofer-Gesellschaft, Arnold Picot, Vorsitzender des Münchner Kreises, oder Herbert Kubicek (Professor für Angewandte Informatik, Universität Bremen). Insgesamt liefert "Medien, Ordnung und Innovation" sehr lesenswerte Beiträge für den organisatorischen Rahmen einer sich dynamisch entwickelnden Informationsgesellschaft. Zu den Beiträgen mit dem höchsten persönlichen Gewinn gehören: Dieter Klumpps "Informationsgesellschaft: Rahmen ohne Bedingungen oder umgekehrt?", Wolfgang Kleinwächters "Internet Governance: Auf dem Weg zu einem strukturierten Dialog", Bernd Holznagels und Daniel Krones ,,Strategien zur Bekämpfung illegaler Inhalte im Internet" oder Edda Müllers und Michael Bobrowskis "Verbraucherschutz in den Telemedien"."
