Abstract
Die wissenschaftsrelevanten Veränderungen des Urheberrechts durch den Zweiten Korb sind kritisch zu bewerten. Die bestehende Abhängigkeit des Wissenschaftlers vom Zugang zu der von ihm benötigten Information ist eine Besonderheit des «Wissenschaftsurheberrechts«, welche gerade im Rahmen der digitalen Vermarktung von wissenschaftlichen Werken immer stärker zum Tragen kommt. Entsprechend bestehen erhebliche Zweifel, ob der bis heute allein über urheberrechtliche Schrankenregelungen versuchte Ausgleich der involvierten Interessen überhaupt zu erreichen ist. Dies gilt umso mehr, als die wissenschaftsspezifischen Schrankenbestimmungen auf dem Ansatz beruhen, den Verlagsangeboten Vorrang einzuräumen; in Wahrheit fehlt auf dem Wissenschaftsmarkt jedoch der dafür notwendige Wettbewerb. Über eine Analyse der Praxistauglichkeit der neuen oder angepassten Schrankenbestimmungen hinaus lohnt es sich daher, über weitere Lösungsansätze nachzudenken, dies zum einen bezogen auf das Urhebervertragsrecht, zum andern aber auch im Bereich des Wettbewerbsrechts.
