Abstract
Novellierungen des Urheberrechts erfolgen in immer schnelleren Abständen. Ursache hierfür sind nur zum geringen Teil Vorgaben der EU-Kommission. Zwei Gründe vor allem sind für die Geschwindigkeit maßgeblich. Zum einen soll das Urheberrecht nicht immer nur der technischen Entwicklung »hinterherhinken«. Zum anderen aber will der Gesetzgeber das Urheberrecht den Bedürfnissen der Wissens- und Informationsgesellschaft anpassen. Dabei stößt er naturgemäß auf diametral entgegengesetzte Interessenlagen: die der Urheber bzw. der Rechteinhaber einerseits und die der Industrie (die möglichst wenig für private Vervielfältigungen bezahlen möchte) sowie insbes.der Nutzer, die den möglichst freien (und vor allem billigen) Zugang zu urheberrechtlich geschützten Werken wünschen. Der Gesetzgeber ist redlich bemüht, diese Interessensgegensätze durch faire Kompromisse zu regeln. Immer häufiger bedient er sich dabei gesetzlicher Lizenzen, die nur durch Verwertungsgesellschaften verwaltet werden können. Die Praxis wird zeigen, ob sich die drei neuen, mit dem sog. Zweiten Korb 2008 eingeführten gesetzlichen Lizenzen bewähren. Schon jetzt freilich lässt sich abschätzen, dass die Abkehr von den gesetzlichen Vergütungen für private Vervielfältigungen zugunsten zwischen Industrie und Verwertungsgesellschaften frei ausgehandelter Vergütungen die Rechtsposition der Urheber deutlich schwächt. Der Zweite Korb hat also den Praxistest noch lange nicht bestanden, da spricht der Gesetzgeber schon über einen Dritten Korb. Der Beitrag geht den einzelnen Neuerungen nach und kommt zum Ergebnis, dass das Urheberrecht - ob man dies wünscht oder nicht - ein Work-in-Progress bleiben wird.
