Abstract
Das Zentrum der Patentwelt verschiebt sich im Zeitalter der Globalisierung nach Asien. Für die künftige Patentwelt ist es nicht entscheidend, ob ihr Zentrum im Westen oder Osten liegt. Aber entscheidend für die künftige Patentwelt ist, dass die Informationsflut für die Prüfer und Rechercheure - unabhängig von ihrem Wohnsitz - beherrschbar bleibt. Die Beherrschbarkeit der Informationen auch künftig zu sichern, bedeutet heute für das Patentwesen, sowohl Bestehendes zu verbessern als auch bisher Bewährtes in Frage zu stellen. Insbesondere die chinesischen Patentanmeldungen und ihre Wachstumsraten (Abb. 1) - als ein Ergebnis der Globalisierung der Wirtschaft in den letzten Jahren - sind Anlass für prinzipielle Veränderungen in der Patentinformation und im Patentrecht. Die Wachstumsraten in Indien und Russland (Abb. 2), aber z.B. auch in den ASEAN-Staaten und Brasilien werden diesen Zwang zusätzlich erhöhen. Kurzzeitig führte die Wirtschaftskrise in den westlichen Industrieländern (Abb. 3) zu einem Rückgang der Patentanmeldungen. Abbildung 3 zeigt den Gleichklang der Wachstumsraten von Bruttoinlandsprodukt und Patentanmeldungen in westlichen Industrieländern. Diese Gesetzmäßigkeit bewirkt, dass mit der Überwindung der Wirtschaftskrise auch die Anzahl der Patentanmeldungen wieder anwächst. In Deutschland verringerten sich 2009 gegenüber 2008 die inländischen Patentanmeldungen um 2,8 Prozent, aber bereits 2010 ging dieser Wert gegenüber 2009 um 1,7 Prozent zurück.
