Abstract
Die Defizite der bisherigen, Bildung und Wissenschaft betreffenden Schrankenregelungen im deutschen Urheberrecht sollten nach den Vorstellungen wichtiger Wissenschaftsorganisationen, wie des Aktionsbündnisses Urheberrecht für Bildung und Wissenschaft, der Allianz der Wissenschaftsorganisationen, der Kulturministerkonferenz, aber auch der international renommierten Wittem-Gruppe, durch eine umfassende Wissenschaftsklausel/-schranke beseitigt werden. Dies liegt im Interesse sowohl von Bildung und Wissenschaft nach einer liberaleren und flexibleren Nutzung von publizierter Information, vor allem für das mit öffentlicher Förderung entstandene Wissen, als auch der auf Innovationen angewiesenen, im internationalen Wettbewerb stehenden Wirtschaft. Die Darstellung konzentriert sich auf den weitgehendsten Vorschlag des Aktionsbündnisses, in der Hoffnung, dass doch noch einer Änderung der in dieser Sach ablehnenden Haltung des Bundesministeriums der Justiz in der Vorbereitung des Dritten Korbs der Urheberrechtsanpassung in Deutschland bewirkt werden kann.
