Abstract

Mit Datum vom 15.10.1992 hat die EG-Kommission nach der Stellungnahme des Europäischen Parlaments und Stellungnahmen durch den Wirtschafts- und Sozialausschuß einen 'geänderten Vorschlag für eine Richtlinie des Rates zum Schutz natürlicher Personen bei der Verarbeitung personenbezogener Daten und zum freien Datenverkehr' vorgelegt. Dieser gegenüber dem ersten Datenschutzrichtlinienvorschlag der EG-Kommission geänderte Vorschlag (zweite Datenschutzrichtlinie) ist die Basis für den vom Rat zu bildenden 'gemeinsamen Standpunkt' gemäß Art.189c EG-Vertrag. Die Analyse dieser Richtlinie soll in Hinblick auf die Entwicklung des Persönlichkeitsschtuzes auf europäischer Ebene unter dem Gesichtspunkt der Informations- und Kommunikationstechnik (IuK) geführt werden. Im Kern geht es dabei um die Verwirklichung der Menschenwürde und der Persönlichkeit und seine Umsetzung in konkrete Datenschutzregelungen in Europa
