    Abstract
    In this global information age, accessing, disseminating, and controlling information is an increasingly important aspect of human life. Often, these interests are expressed in the language of human rights-for example, rights to expression, privacy, and intellectual property. As the discipline concerned with "facilitating the effective communication of desired information between human generator and human user" (Belkin, 1975, p. 22), library and information science (LIS) has a central role in facilitating communication about human rights and ensuring the respect for human rights in information services and systems. This paper surveys the literature at the intersection of LIS and human rights. To begin, an overview of human rights conventions and an introduction to human rights theory is provided. Then the intersections between LIS and human rights are considered. Three central areas of informational human rights-communication, privacy, and intellectual property-are discussed in detail. It is argued that communication rights in particular serve as a central linchpin in the system of human rights.

    Es kann nicht Aufgabe der Politik sein, kommerziellen Anbietern quasi ein Monopol für den elektronischen Dokumentenversand zu sichern, zumal deshalb nicht, weil diese die Wissensobjekte, die sie in Zeitschriften veröffentlichen, in der Regel kostenlos von mit öffentlichen Mitteln finanzierten Institutionen und Personen erhalten. Die Rechtfertigung für Verlage, mit solchen Produkten auf den Märkten zu handeln und damit Gewinn zu machen, beziehungsweise die Rechtfertigung für gesetzlich zugestandene Privilegien sollte sich allein aus der Fähigkeit der Anbieter ableiten, aus dem kostenlos gelieferten Wissen Produkte mit attraktiven Mehrwerteigenschaften zu machen und diese Produkte den zurückkaufenden öffentlichen Einrichtungen zu nicht restriktiven, vor allem auch für Studierende nicht prohibitiven Bedingungen zur Verfügung zu stellen. Der letzte Halbsatz in Paragraf 53a mit der Monopolzuweisung an Verlage darf nicht erhalten bleiben - darin ist sich das Aktionsbündnis mit dem DBV einig. Für ihn gibt es keine Begründung, erst recht nicht durch eine Berufung auf den Dreistufentest. Tucholsky, leicht abgewandelt, hatte wohl recht: Das Gegenteil von gut ist nicht schlecht, sondern gut gemeint. Sollte nicht der DBV seine Energie entsprechend seiner Unterzeichnung der Berliner Erklärung zu Open Access auf ganz andere Aktivitäten richten? Bibliotheken haben alles dafür zu tun, dass freien, in elektronischen Umgebungen möglichen Formen für Produktion, Bereitstellung und Nutzung von Wissen auf breiter Front Geltung verschafft wird. Ist das so, hätte es durchaus einmal nützlich sein können, Verhandlungen an die Wand zu fahren, die dafür nicht zielführend sind. Und ebenfalls könnte es durchaus zu einem erfolgreichen Scheitern kommen, wenn die Politik ein schlechtes Gesetz macht. Die Praxis wird das dann schnell als obsolet erkennen und Gegenmaßnahmen ergreifen. Gegen die Interessen von Bildung und Wissenschaft, und damit gegen die Interessen der Öffentlichkeit, kann auf Dauer niemand Politik machen. Ich möchte entsprechend an das Selbstbewusstsein der Bibliothekare und die Stärke der Bibliotheken appellieren. Es müssen und können andere und bessere Formen der Zusammenarbeit und der Koexistenz von Bibliotheken und kommerziellen Informationsanbietern gefunden werden."
