    Abstract
    The nature and implications of electrocopying are summarised. After a brief review of the principles of copyright, the issue of whether electrocopying infringes copyright is debated. Publishers are aware of the threat that electrocopying poses to their business. The various options available to publishers for responding to electrocopying are summarised. Patterns of scholarly communications and the relationships between authors, publishers and libraries are being challenged. Constructive dialogue is necessary if the issues are to be resolved

    Abstract
    Discusses the publishing of books online on the Internet, in the USA. The issues is treated mainly in relation to trade publishers. Outlines various ways in which such publishers have so far used the Internet, for example in the publishing of the full text of works of fiction, for publishing catalogues, and for presenting authors to the public via bulletin boards or electronic conferences. Notes a number or problems which arise: copyright, payment for accessing items, advertising restrictions, and the ease with which the published unit can be tampered with when available on the Internet. Also discusses collaboration and conflicts between publishers and the technology industry

    Abstract
    Technological developments have changed the concepts of publication, reproduction and distribution. However, legislation, and in particular the Legal Deposit Law has not adjusted to these changes - it is very restrictive in the sense of protecting the rights of authors of electronic publications. National libraries and national archival institutions, being aware of their important role in preserving the written and spoken cultural heritage, try to find different legal ways to live up to these responsibilities. This paper presents some legal aspects of archiving Web pages, examines the harvesting of Web pages, provision of public access to pages, and their long-term preservation.

    Ablieferung als PDF oder Zip-Archiv Geschehen soll die Ablieferung am liebsten in PDF-Form, über ein Webformular. Bei Bedarf, nämlich "wenn Ihre Netzpublikation aus mehreren Dateien besteht, z. B. einer oder mehreren HTML-Seiten mit Bildern", darf man sie auch auch als Zip-Archiv abgeben. Wie es sich mit privaten Webseiten genau verhält, ist derzeit nicht ganz klar. "Lediglich privaten Zwecken dienende Websites" sind beispielsweise freigestellt - aber was genau ist im Netz lediglich privat? Ein Blog? Auch, wenn darin das Weltgeschehen oder die deutsche Politik kommentiert wird? Auch dann, wenn neben den Blog-Einträgen Google-Anzeigen erscheinen? Da es sich um eine Pflichtabgabe handelt, ist sie, zumindest theoretisch, auch strafbewehrt. Nach einer Abmahnung kann es heise.de zufolge bis zu 10.000 Euro Strafe kosten, wenn man seine Netz-Inhalte nicht bei der DNB abliefert. Eine Erklärseite der DNB schränkt allerdings ein: "Die Entwicklung geeigneter Verfahren für den Massenbetrieb der Sammlung, Erschließung und Archivierung von Netzpublikationen erfolgt stufenweise." Im Klartext: Man weiß bei der DNB selbst noch nicht so genau, wie das alles funktionieren und organisiert werden soll. So lange das nicht abschließend geklärt ist, wird die Bibliothek "keine Ordnungswidrigkeitsverfahren anstrengen". Außerdem werde man "abzuliefernde Netzpublikationen gegebenenfalls nicht gleich übernehmen, sondern vormerken und erst anfordern, wenn der Stand der Technik und der Absprachen dies zulässt." Zudem hat die Bibliothek das Recht, von der Übernahme von Inhalten abzusehen, unter anderem dann, wenn "technische Verfahren die Sammlung und Archivierung nicht oder nur mit beträchtlichem Aufwand erlauben". Bleibt abzuwarten, wie weit die Nationalbibliothek diese Ausnahmen ausdehnen wird - sonst kommt ein Speicherplatzbedarf auf die Einrichtung zu, der den Steuerzahler beträchtliche Summen kosten dürfte."

    Abstract
    In einer digitalen Wissensgesellschaft kommt dem Urheberrecht eine herausragende Bedeutung zu. Es ist - wie auch das Datenschutzrecht (s. Kapitel F 4 Informationelle Selbstbestimmung und Informationsfreiheit) - Kernbestandteil eines Kommunikationsrechts, das die Weitergabe und Nutzung von Informationen regelt. Daher mag es paradox klingen, dass das Urheberrecht Informationen - wie auch Ideen oder (wissenschaftliche) Theorien - überhaupt nicht schützt.1 Vielmehr greift sein Schutz erst, wenn sich Information z. B. in Form eines gedruckten oder digitalen Textes oder auch einer Rede manifestiert. Dieser richtet sich dann aber nicht auf den Informationsgehalt an sich, sondern seine Verkörperung in Form eines originellen und individuellen Werkes (s. Abschnitt 2 und 3).

    "Unter "Informationsfreiheit" versteht man das Prinzip, dass die Unterlagen und Daten öffentlicher Stellen im Regelfall für jeden Bürger zugänglich sind. Deutschland ist neben Luxemburg das letzte Land in der Europäischen Union, das diese Offenheit nicht praktiziert, sondern am obrigkeitsstaatlichen Prinzip des so genannten "Amtsgeheimnisses" festhält: Bei uns gilt bisher der Grundsatz, dass Informationen der Verwaltung nur im Ausnahmefall an interessierte Bürger weitergegeben werden, z. B. wenn die Antragsteller Akteneinsicht in eigener Sache begehren. Ein Informationsfreiheitsgesetz würde dagegen einen Informationsanspruch für jeden schaffen - unabhängig von der direkten Betroffenheit und sogar ohne dass ein solcher Antrag begründet werden müsste. Das Informationsfreiheitsgesetz (IFG) würde die Beweislast umkehren: Nicht mehr die Antragsteller müssten ihren Informationsanspruch begründen, sondern die Ämter oder Behörden müssten darlegen, warum sie im Ausnahmefall etwas nicht herausgeben können, weil z. B. der Datenschutz dem entgegensteht oder der Schutz von Betriebs- und Geschäftsgeheimnissen. - Keine zusätzliche Bürokratie - Bisher wurden Informationsfreiheitsgesetze in den Bundesländern Brandenburg, Berlin, Schleswig-Holstein und Nordrhein-Westfalen eingeführt. Die Erfahrungen dort zeigen, dass die meisten Bürger die Transparenzverpflichtung nutzen, um ganz nahe liegende Dinge aus ihrem Wohnumfeld oder Interessengebiet zu erfragen: So kann man per Akteneinsicht oder durch eine schriftliche Auskunft (Aktenkopien) z. B. in Erfahrung bringen, was die Brandschutzbegehung im Kindergarten um die Ecke ergeben hat, wie die jüngste Verkehrszählung ausgefallen ist, oder was bei der Lebensmittelkontrolle gefunden wurde. Die befürchtete "Antragsflut" und zusätzliche Bürokratie, die die Gegner der Informationsfreiheit gerne ins Feld führen, ist nirgendwo eingetreten. Im Gegenteil: Das Mehr an Demokratie, das mit einer bürgernahen offenen Verwaltung einhergeht, "wurde mit dem IFG "günstig eingekauft", so der Innenminister von Nordrhein-Westfalen, Fritz Behrens, über die Praxiserfahrungen auf Länderebene.

    Abstract
    One year after the World Interllectual Property Organization conference in Geneva, the European Commission has recognized its proposal for the directive on the harmonisation of certain aspects of authors' and related rights in the information society. The text is a keystone of european legislation in the area of intellectual property and gives the first complete definition of the 2 major components of the authors' rights, the right of reproduction and the right of communication to the public, and endeavors to adapt these to the new electronic environment. This definition has consequences for owners as well for users. It governs the future methods of utilization of works on the network and designates the strength of relations among the different participants in the information society

    In addition to stipulating economic rights, the copyright laws of most nations grant authors a series of "moral rights." The development of digital information and the new possibilities for information processing and transmission have given added significance to moral rights. This article briefly explains the content and characteristics of moral rights, and assesses the most important aspects of legislation in this area. The basic problems of the digital environment with respect to moral rights are discussed, and some suggestions are made for the international harmonization of rules controlling these rights

    Abstract
    Downloading and information filtering are prerequisites for efficient use of electronic documents available in databases or on the Internet. Taking full advantage of electronic text collections requires a proper legal framework. Under present copyright law, electronic copying is subject to prior consent from the copyright owner, with due regard to fair use exceptions. This approach is followed by the European Union in its Database Protection Directive. The Directive leaves important questions concerning the fair use doctrine, compulsory licenses, and non copyright ('copyleft') to be resolved by national implementation as well as contractual arrangements between publishers and authors. The Directive's strong emphasis on direct revenues from users to copyright owners should be supplemented by compulsory licenses. Unrestricted access to information adds enormous value to database use and would result in more revenue for the authors and makers of databases. If the public's interest in access to information id deemed paramount to private copyright, government should intervene to secure sufficient revenues for the copyright owners
