    Abstract
    The concept of intellectual property is fallacious, and danegrous as it permits ordinarily honest citizens to reproduce everything from software to musical scores without authorization or compensation to the copyright holder. Intellectual property rights are really property rights. There is a need to deal with the issues in which terminology is outstripping legal protection and how proprietary claims as such are under assault. In the context of the US National Information Infrastructure this means a greater clarification of fundamental issues, followed by policy guidelines that can be understood as universal in scope and fair in purpose. The US government must advance the cause of the widest possible access of information to its citizens, while at the same time protecting the sources of creative energies

    Abstract
    Management of rights in electronic resources on the Internet is a complex issue. this can be considered almost universal knowledge, as paraphrases of this statement can be found in many discussions on this subject. This being the case, it is not surprising that a definition, operational solution to the problem has yet to be found. In one of the world's leading metadata initiatives, the Dublin Core Metadata Initiative, discussions on this topic over several years have failed to reach a conclusion. Some people think the issue is simply too complex to handle, others that the provision of simple shortcuts to more detailed information should be sufficient. It could be argued that a solution to the issue is in fact out of scope for the Dublin Core element set, in so far as it aims only to establish a core set of descriptive metadata for resource discovery

    Abstract
    Mit Referenz auf Art. 19 der Universal Declaration of Human Rights wurde vor gut 25 Jahren eine erbitterte Auseinandersetzung um das "right to communicate" (r2c) als zentraler Bestandteil einer "New World Information and Communication Order" (NWIKO) geführt, die sich heute, unter veränderten Rahmenbedingungen, aber mit ähnlicher politischer, ökonomischer und medialerRelevanz und Brisanz, auf dem Weg zum Weltgipfel zur Informationsgesellschaft (WSIS) wiederholt. Erneut geht es zwar auch um Meinungs-/Medien-/Pressefreiheit aber in erster Linie darum, wer in globaler Hinsicht die Organisationsformen bzw. den Umgang mit Wissen und Information dominieren kann. Es werden die wesentlichen Argumente des alten Streits um die NWIKO im Lichte der aktuellen Entwicklung des WSIS reinterpretiert und zwar aus politischer, medienpolitischer und menschenrechtlicher Sicht. Der Wechsel vom Distribu-tions- zum Interaktions- und Kommunikationsparadigma macht neue Formen medialer Öffentlichkeit, kooperativer Partizipation in der Wirtschaft aber auch kollaborativer Erarbeitung von Wissen und Information und dessen Verteilung möglich. Es wird die These aufgestellt, dass die derzeit von (großen Teilen aus) Politik, Wirtschaft und den Medien mit Vehemenz betriebene Abwehr von r2c als Bestandteil der offiziellen WSIS-Verlautbarungen in ersterLinie der Besitzstandswahrung dient. Es könnte so die Chance verpasst werden, über ein zugestandenes r2c den Weg für neue, elektronischen Umgebungen angemessene Produktions-, Verteil- und Nutzungsformen für den Umgang mit Wissen und Information zu öffnen. Informationsgesellschaften können sich erst dann zu inklusiven und nachhaltigen Gesellschaften entwickeln, wenn Kommunikationsrechte tatsächlich auch von allen zur Überwindung der verschiedenen Ausprägungen des Digital divide wahrgenommen werden können.'

    Grundrechte schützen vor Eingriffen des Staates in die Freiheit seiner Bürger. Problematisch ist aber, ob sie auch einen Anspruch auf konkrete Leistungen gewähren. Schon mit Blick auf die begrenzten haushaltsrechtlichen Möglichkeiten wird man das verneinen müssen. Gleichwohl geben Grundrechte einen Anspruch auf Teilhabe, wenn der Staat bestimmte Leistungen bereitstellt. Vor diesem Hintergrund erörtert Köppen den Anspruch des Bürgers auf »monopolisierte staatliche Information«. Hierzu zählt er ausdrücklich auch die Bestände der in staatlicher Trägerschaft befindlichen Bibliotheken (S.236). Da diese in der Regel dem Gemeingebrauch gewidmet sind, dürfte es hier kaum Probleme geben. Für Behördenbibliotheken mit Spezialbeständen wird man sich Köppens Ansicht anschließen können, dass potenzielle Empfänger einer in staatlicher Hand monopolisierten Information einen Anspruch auf Herstellung von Allgemeinzugänglichkeit haben, wenn sie ein berechtigtes Interesse an den Informationen nachweisen (S.236). Es wurde schon angemerkt: Bibliotheken spielen in Köppens Arbeit keine Rolle. Auch die einschlägige bibliotheksrechtliche Literatur, an der kein Mangel besteht, wurde nicht verarbeitet. Dem Autor wird man hier kaum einen Vorwurf machen können, bewegt er sich in seiner Darstellung doch nur in den vom verfassungsrechtlichen Schrifttum vorgezeichneten Bahnen. Auch dort ist von Bibliotheken kaum die Rede. Wenn man die Register der einschlägigen Kommentare und Handbücher konsultiert, sucht man das Stichwort »Bibliothek« vergeblich. Umgekehrt und merkwürdigerweise fehlt auch im sonst so ausführlichen »Lexikon des gesamten Buchwesens« ein Lemma »Informationsfreiheit«. Hier fragt man sich: Ist denn der Themenkomplex »Bibliothek und Informationsfreiheit« wirklich so selbstverständlich, dass eine literarische Abhandlung dazu überflüssig erscheint? Wenn man die Arbeit von Köppen aufmerksam liest, dann ist das zu verneinen. Gerade Fragen der Gebühren für Bibliotheksbenutzung und die in manchen Hochschulen zu beobachtende Tendenz, externe Nutzer in Hochschulbibliotheken als »einrichtungsfremde« Leser kritisch zu sehen, sollten für Bibliothekare Anlass genug sein, sich intensiver dem Grundrecht der Informationsfreiheit zuzuwenden und die Einrichtung und den Betrieb von Bibliotheken als wichtige Bedingung der Grundrechtsverwirklichung zu begreifen. Hier bietet Köppens Arbeit solide Hintergrundinformationen. Wer sie durchgearbeitet hat, kann mit Unterhaltsträgern und Kritikern einer weitherzigen Bibliothekspolitik sachlich und kompetent diskutieren."
