    Explains the legal aspects of copyright. Under English law, copying includes electronic copying of works. Takes the example of a company wishing to store its in house cuttings library of other people's news cuttings on disc. One option is to retain the newspapers. Another is to contact the publishers, which presents enormous difficulties. The Copyright Licensing Agency at present only deals with photocopying and has no mandate from newspaper publishers to include their works in such schemes

    The nature and implications of electrocopying are summarised. After a brief review of the principles of copyright, the issue of whether electrocopying infringes copyright is debated. Publishers are aware of the threat that electrocopying poses to their business. The various options available to publishers for responding to electrocopying are summarised. Patterns of scholarly communications and the relationships between authors, publishers and libraries are being challenged. Constructive dialogue is necessary if the issues are to be resolved

    Presents a summary of a report published by the US Department of Commerce on the impact of the National Information Infrastructure (NII), the information superhgihway, on copyright laws in the USA. Explains the backgroud to the report, the aims of the NII, the role of the Information Infrastructure Task Force (IITF) set up by the Clinton administration, and the work of the Working Group on Intellectual Property Rights within the IITF. Presents the report's recommendations to the US Congress on changes to copyright laws, including clarification of the copyright owner's distribution right and amendment of library privileges to bring them into the digital age.

Mai 2001 zur "Harmonisierung bestimmter Aspekte des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft" (2001/29/EG) hat das Bundesjustizministerium im März 2002 einen "Entwurf eines Gesetzes zur Regelung des Urheberrechts in der Informationsgesellschaft" vorgelegt. Dieser wurde - nach weiteren Anhörungen und Würdigung zahlreicher Stellungnahmen der betroffenen Interessengruppen - Ende Juli vom Bundeskabinett verabschiedet und als Regierungsentwurf in die Ausschüsse überwiesen. Es ist jedoch nicht mehr gelungen, das Gesetz vor Ablauf der Legislaturperiode in den Deutschen Bundestag zu bringen und nach Lesung zu beschließen. Somit muss das Gesetzgebungsverfahren nach Bundestagswahl, Regierungsbildung und Konstitution des Bundestags neu in Gang gesetzt werden. Ob es unter diesen Umständen möglich sein wird, mit dieser Gesetzesnovelle die EURichtlinie - wie gefordert - bis zum Jahresende 2002 umzusetzen, ist fraglich.

    Abstract
    In this global information age, accessing, disseminating, and controlling information is an increasingly important aspect of human life. Often, these interests are expressed in the language of human rights-for example, rights to expression, privacy, and intellectual property. As the discipline concerned with "facilitating the effective communication of desired information between human generator and human user" (Belkin, 1975, p. 22), library and information science (LIS) has a central role in facilitating communication about human rights and ensuring the respect for human rights in information services and systems. This paper surveys the literature at the intersection of LIS and human rights. To begin, an overview of human rights conventions and an introduction to human rights theory is provided. Then the intersections between LIS and human rights are considered. Three central areas of informational human rights-communication, privacy, and intellectual property-are discussed in detail. It is argued that communication rights in particular serve as a central linchpin in the system of human rights.

    Abstract
    Mit Verkündung im Bundesgesetzblatt trat am 13. September 2003 die Urheberrechtsnovelle in Umsetzung der EU-Urheberrechtsrichtlinie in der Informationsgesellschaft in Kraft. Seitdem gelten die neuen Rechte der öffentlichen Zugänglichmachung (§ 19 a UrhG) und das Recht der Schutzmaßnahmen (§ 95 a UrhG) sowie die entsprechenden Ausnahmetatbestände, der umstrittene § 52 a UrhG (öffentliche Zugänglichmachung im Rahmen des Unterrichts und der Wissenschaft) sowie § 95 b UrhG (Durchsetzung der Schranken bei technischer Maßnahme)'. Eine Reihe von Erwartungen blieben offen, wie die Durchsetzung der Privatkopie, der elektronische Pressespiegel, die sog. On the Spot Consultation in Bibliotheken und das Ranking von Vergütungssystemen, von der pauschalen Tantieme, wie die Vergütung für die Privatkopie mittels Geräteabgabe, bis zur Einzellizenzierung mittels DRM. Diese sollen im sog. Zweiten Korb zur Modernisierung des Urheberrechts in der Inforrnationsgesellschaft behandelt werden. Am 16. September lud die Bundesjustizministerin, Frau Brigitte Zypries, gemeinsam mit dem Institut für Urheber- und Medienrecht nach München zu einem Symposium ein und ließ insgesamt 20 Interessenvertreter zu Wort kommen.' Die Wortmeldungen werden in Kürze in einem Sonderheft der Fachzeitschrift ZUM nachzulesen sein. Zugleich wurden alle am Urheberrecht interessierten Kreise aufgefordert bis Ende Oktober ihre Erwartungen an den 2. Korb in schriftlichen Stellungnahmen dem BMJ zuzuleiten. Zur Hilfestellung gab es einen Fragenkatalogs mit an die Hand. In diesem waren alle Forderungen aus Stellungnahmen zur ersten Novelle, die nicht berücksichtigt wurden, aufgelistet. Völlig neu aber ist das Herangehen an die Erarbeitung des neuen Referentenentwurfs. Die unterschiedlichen Interessenvertreter werden in Arbeitsgruppen, 11 an der Zahl, bis März den Regelungsbedarf diskutieren und formulieren. Der Start dazu wurde am 16. Oktober im BMJ gegeben. Eine Arbeitsgruppe trägt den Titel "Schranken des Urheberrechts" und darin sind auch die bibliothekarischen Interessenverbände vertreten. Hier wird es darum gehen, die in der offiziellen Stellungnahme des Deutschen Bibliotheksverbands vorgetragenen Erwartungen einzubringen. Nachdem die Bibliotheksverbände und der Börsenverein sich auch außerhalb der Berufsöffentlichkeit um den Eingang des § 52 a UrhG in das Urheberrechtsgesetz vehement gestritten haben, soll dies beim 2. Korb vermieden werden. Beide Seiten wollen nunmehr im Vorfeld der parlamentarischen Behandlung ihre gegenseitigen Erwartungen offen miteinander diskutieren. Dazu wird im Dezember ein Treffen mit Vertretern des Börsenvereins und des Deutschen Bibliotheksverbands in Berlin stattfinden. Im Folgenden sei die Stellungnahme der Rechtskommission des Deutschen Bibliotheksverbandes e.V. zu den Erwartungen an den Zweiten Korb der Urheberrechtsnovelle in der Informationsgesellschaft anhand des Fragenkatalogs des BMJ und des weitergehenden Regelungsbedarf aus Sicht der Bibliotheksarbeit vorgestellt. Da die Stellungnahme für das Referat Urheber- und Verlagsrecht beim BMJ geschrieben wurde, fehlt es an Einführungen in die Themen. Zum besseren Verständnis sind deshalb Erläuterungen (kursiv gesetzt) eingefügt.

Gleiches gilt auch für Werke aus Buchverlagen: "Nicht nur Bücher, sondern auch durch Rechtemanagementsysteme geschützte CD-ROMs oder eBooks dürfen von Der Deutschen Bibliothek nun zur Weitergabe an Berechtigte vervielfältigt werden", erklärt Wulf D. von Lucius, Vorsitzender des Urheberrechtsausschusses des Börsenvereins des Deutschen Buchhandels. Musikwirtschaft und Buchbranche haben zu diesem Zweck eine Vereinbarung mit Der Deutschen Bibliothek getroffen. Hiermit sind die berechtigten Interessen Der Deutschen Bibliothek und einzelner Nutzer, aber auch die Interessen der Rechteinhaber und Verwerter gesichert. Der Verbreitung von Kopien wird zunehmend mit Kopierschutz- und Digital Rights Management Systemen begegnet. Von dem im Urheberrechtsgesetz festgesetzten Verbot der Umgehung solcher technischer Schutzmaßnahmen ist auch Die Deutsche Bibliothek in ihrem Sammel-, Bereitstellungs- und Archivierungsauftrag als Nationalbibliothek betroffen. Um eine Langzeitarchivierung der von der Nationalbibliothek zu sammelnden Veröffentlichungen gewährleisten zu können, müssen die Medien in regelmäßigen Abständen an die aktuellen Datenformate, Betriebssysteme und Datenträger angepasst werden. Das Urheberrechtsgesetz sieht so genannte Schrankenregelungen vor, nach denen der Zugang zu urheberrechtlich geschützten Werken zu bestimmten Zwecken, wie zum Beispiel für wissenschaftliche und kulturelle Nutzungen, zulässig ist. Die letzte Novelle des Gesetzes, deren einschlägige Regelungen im September 2004 in Kraft getreten sind, sieht hierfür ausdrücklich die Möglichkeit von Vereinbarungen zwischen Verbänden vor, um diese Nutzungen auch von kopiergeschützten Medien zu ermöglichen. Als erste Branchen haben nun die Musikwirtschaft und die Buchbranche diese Möglichkeit genutzt und mit Der Deutschen Bibliothek eine vertragliche Vereinbarung geschlossen. "Die jetzt geschlossene Vereinbarung erlaubt Der Deutschen Bibliothek eine rationelle Erfüllung ihres gesetzlichen Auftrages und schafft Klarheit für den Umgang mit geschützten Medien wie Tonträgern und CD-ROMs im Verhältnis zu den Nutzern der Einrichtungen. Damit wird Rechtssicherheit für die Arbeit Der Deutschen Bibliothek geschaffen.", erklärt Elisabeth Niggemann, Generaldirektorin Der Deutschen Bibliothek. Nach der geschlossenen Vereinbarung darf Die Deutsche Bibliothek Vervielfältigungen für die eigene Archivierung, für den wissenschaftlichen Gebrauch von Nutzern, für Sammlungen für den Schul- oder Unterrichtsgebrauch, für Unterricht und Forschung sowie von vergriffenen Werken anfertigen. Um Missbrauch zu vermeiden, wird Die Deutsche Bibliothek das Interesse von Nutzern zur Anfertigung einer solchen gebührenpflichtigen Vervielfältigung prüfen und die Kopien möglichst mit personalisierten digitalen Wasserzeichen versehen.
