    Abstract
    One year after the World Interllectual Property Organization conference in Geneva, the European Commission has recognized its proposal for the directive on the harmonisation of certain aspects of authors' and related rights in the information society. The text is a keystone of european legislation in the area of intellectual property and gives the first complete definition of the 2 major components of the authors' rights, the right of reproduction and the right of communication to the public, and endeavors to adapt these to the new electronic environment. This definition has consequences for owners as well for users. It governs the future methods of utilization of works on the network and designates the strength of relations among the different participants in the information society

    Abstract
    Im österreichischen Urheberrecht sind die Verwertungsrechte der Urheber taxativ aufgezählt gemeinsame Basis der Rechte verbunden mit den Einschränkungen, die als die sogenannte, gesetzlichen Lizenzen bekannt sind. Die Entwicklung der neuen Medien brachte eine Veränderung in das bisherige Urheberrechtsgefüge insofeme, als sich die gewohnte Balance zwischen Urhebern und der Offentlichkeit zugunsten der Rechtsinhaber verlagert hat. Damit hat eine neu Rechtsform, die der Lizenz an Bedeutung gewonnen. Bei der Aushandlung von Lizenzverträgen stehen die Bibliotheks- Informations- und Dokumentationseinrichtungen BDI zurückgedrängt in eine schwächere Position gegenüber dem Lizenzgeber, der zumeist als Monopolist auftritt, vor de Schwierigkeit, derartige Verträge zu einem für alle Beteiligten befriedigenden Abschluß zu bringen. Beim Abschluß eines Lizenzvertrages, mit dem die Befugnis, fremde Schutzrechte zu nutzen, übertragen wird, sind verschiedene Aspekte besonders zu beachten: U.a. die Rechte und Pflichten des Lizenzgebers- und nehmers, Störungen, Abtretung, Lizenzgebühr, Geheimhaltungsklauseln und bei internationalen Verträgen insbesondere die Wahl des Rechtssystems und de Gerichtsstands sowie die Vereinbarung von Schiedstellen. Bei der Charakterisierung des Lizenzvertrages als synallagmatischen Vertrag gilt es, in Zukunft eine der Öffentlichkeit auf Zugang zu Information wahrzunehmen

    Describes ELINOR (Electronic Library Information Online Retrieval), the electronic library project of De Montfort University, based at Milton Keynes, UK. The project uses document image processing to build a document database containing the full contents of undergradutae texts, including copyright material and University documents.     Explains the legal aspects of copyright. Under English law, copying includes electronic copying of works. Takes the example of a company wishing to store its in house cuttings library of other people's news cuttings on disc. One option is to retain the newspapers. Another is to contact the publishers, which presents enormous difficulties. The Copyright Licensing Agency at present only deals with photocopying and has no mandate from newspaper publishers to include their works in such schemes

    The nature and implications of electrocopying are summarised. After a brief review of the principles of copyright, the issue of whether electrocopying infringes copyright is debated. Publishers are aware of the threat that electrocopying poses to their business. The various options available to publishers for responding to electrocopying are summarised.     Abstract
    Am 11. April 2003 beschloss der Deutsche Bundestag in zweiter und dritter Lesung das Gesetz zur Änderung des Urheberrechts in der Informationsgesellschaft. Diesem ging nicht nur im Bundestag eine heiße Debatte voraus. So startete der Börsenverein einen öffentlichen Diskussionsprozess unter dem Motto "Stellen Sie sich vor, Sie schreiben ein Buch und der Staat nimmt es Ihnen einfach weg" mit dem Ziel, den neuen § 52 a UrhG und das Recht auf digitale Kopie nach § 53 UrhG zu verhindern (www.52a.de). Die Bibliotheksund informationswissenschaftlichen Verbände entgegneten mit eigenen Pressekonferenzen, Presseerklärungen und Stellungnahmen (wwwbibliotheksverband. de). Das Parlament beschloss den Gesetzesentwurf mit einigen Kompromissen im § 52 a UrhG und legte sich die Pflicht zur Evaluation zum 31. Dezember 2006 auf. Der folgende Beitrag soll allen DGI-Mitgliedern einen schnellen Überblick über die wesentlichen Neuerungen bieten und sie vertraut machen mit den beiden neuen Rechten der Urheber und anderen Leistungsschutzberechtigten: dem Recht der öffentlichen Zugänglichmachung (§ 19 a UrhG) und dem Schutz technischer Maßnahmen (§ 95 a UrhG) sowie den entsprechenden Ausnahmen und Beschränkungen im Allgemeininteresse. Zum besseren Verständnis wird auch auf bereits geltendes Recht verwiesen, soweit es elektronische Produkte und Verfahren betrifft. Die Gesetzesnovelle nimmt ausdrücklich Bezug auf digitale Netzwiedergaben und Vervielfältigungsverfahren. Bei der Anwendung von Ausnahmetatbeständen wurde erstmals zwischen wirtschaftlichem und nichtwirtschaftlichem Gebrauch unterschieden. Für Unternehmen, Firmen und Selbstständige gilt es danach, Einschränkungen zu beachten. Für alle analogen Werke und Verfahren gilt der Besitzstand, d.h. es wurden keine Veränderungen vorgenommen.

    Presents a summary of a report published by the US Department of Commerce on the impact of the National Information Infrastructure (NII), the information superhgihway, on copyright laws in the USA. Explains the backgroud to the report, the aims of the NII, the role of the Information Infrastructure Task Force (IITF) set up by the Clinton administration, and the work of the Working Group on Intellectual Property Rights within the IITF. Presents the report's recommendations to the US Congress on changes to copyright laws, including clarification of the copyright owner's distribution right and amendment of library privileges to bring them into the digital age.

    Abstract
    In this global information age, accessing, disseminating, and controlling information is an increasingly important aspect of human life. Often, these interests are expressed in the language of human rights-for example, rights to expression, privacy, and intellectual property. As the discipline concerned with "facilitating the effective communication of desired information between human generator and human user" (Belkin, 1975, p. 22), library and information science (LIS) has a central role in facilitating communication about human rights and ensuring the respect for human rights in information services and systems. This paper surveys the literature at the intersection of LIS and human rights. To begin, an overview of human rights conventions and an introduction to human rights theory is provided. Then the intersections between LIS and human rights are considered. Three central areas of informational human rights-communication, privacy, and intellectual property-are discussed in detail. It is argued that communication rights in particular serve as a central linchpin in the system of human rights.
