    Bereits im Juni 2004 hatten der Börsenverein des Deutschen Buchhandels und die Vereinigung internationaler Fachverlage, Stichting STM, Klage gegen das elektronische Verschicken von kopierten beziehungsweise gescannten Artikeln durch subito erhoben. Besonders Fachverlage sehen den von subito angebotenen Dienst kritisch, bieten sie doch mittlerweile selbst Einzelartikel online zum kostenpflichtigen Download an. In seiner Klageerwiderung argumentierte der Dokumentenlieferdienst damit, dass der angebotene Service im Rahmen der Urheberrechtsgesetze liege und es keine Konkurrenzsituation zwischen subito und den Verlagen gebe. Ob subito gegen das jetzt ergangene Urteil des Oberlandesgerichts München in die Revision geht, stand bei Redaktionsschluss noch nicht fest. Zum Hintergrund: Im Jahre 1999 hatte der Bundesgerichtshof der TIB in einem Grundsatzurteil den Kopienversand ausdrücklich erlaubt. Das Oberlandesgericht München und auch der gegenwärtige Regierungsentwurf zur Reform des Urheberrechts würden die vergleichbare elektronische Form des Kopienversands für das elektronische Zeitalter zunichte machen."

    "Die »Göttinger Erklärung« des Aktionsbündnisses haben viele Bibliothekar/innen unterschrieben. Aber gewiss anerkennen auch alle anderen Unterzeichner die Bemühung der Bibliotheken, für Bildung und Wissenschaft akzeptable Nutzungsbedingungen bei der Bereitstellung auch elektronischer Dokumente durch Verhandlung zu erreichen. Wir alle sehen die schwierige Lage, in die die Bibliotheken (und damit Bildung und Wissenschaft) durch den aktuellen Regierungsentwurf zum Urheberrecht gebracht worden sind, vor allem durch den Normvorschlag in Paragraf 53a, durch welchen den Bibliotheken faktisch der elektronische Kopienversand (auch in grafischer Form) untersagt wird, wenn Verlage ein entsprechendes Marktangebot bereitstellen. Niemand kann wollen, dass die Bibliotheken sozusagen ins Steinzeitalter der Informationsversorgung zurückversetzt werden. Das zu verhindern, wird das wesentliche Ziel der Bibliothekarsvertreter des DBV gewesen sein. Die oben genannte Vereinbarung weist jedoch in die falsche Richtung und ist auch weder von der Zielsetzung noch in den Details verträglich zum Beispiel mit jüngsten Stellungnahmen der Bund-Länder-Kommission für Bildungsplanung und Forschungsförderung (BLK) oder der Deutschen Forschungsgemeinschaft (DFG), um nur diese Organisationen zu nennen, geschweige denn mit den Zielen des Aktionsbündnisses. Der grundlegende Fehler ist der, dass sich der DBV offenbar mit der in Paragraf 53a-RegE getroffenen Unterscheidung zwischen analogem und digitalem Versand von Dokumenten abgefunden hat, sodass es jetzt nur um Schadensbegrenzung ging - anstatt offensiv das Ziel einer voll-elektronischen Informationsversorgung für Bildung und Wissenschaft anzustreben. Die Schadensbegrenzung wird zugegebenermaßen ansatzweise erreicht, allerdings nur durch ein kompliziertes System von gesetzlichen und Zwangslizenzen, bei denen die Bedingungen der Vergütung noch gänzlich im Unklaren sind. Wie weit das Ganze überhaupt trägt, ist zweifelhaft, da der Börsenverein kaum für die den Markt beherrschenden internationalen (Zeitschriften-) Verlage sprechen kann.
    Angesichts der möglicherweise gravierenden Reichweite von solchen Vereinbarungen hat das Aktionsbündnis die politischen Vertreter gebeten, dass Bildung und Wissenschaft direkt in solche Verhandlungen und Vereinbarungen einbezogen werden. Die elektronische Dokumentversorgung ist für Bildung und Wissenschaft zu wichtig, als dass sich die Politik alleine auf eine Einigung zwischen Börsenverein und DBV stützen könnte. Das Aktionsbündnis sowie Vertreter aus dem Kreis der Allianz der Wissenschaftsorganisationen oder der BLK sowie der Kultusministerkonferenz (KMK) gehören mit an den Verhandlungstisch. Mit dem Gewicht dieser Partner sollte das derzeit Mögliche ausgehandelt werden können. Auf keinen Fall sollte diese Vereinbarung über eine dann daraus abzuleitende vertragliche Vereinbarung als Ersatz für eine umfassendere, verbindlichere und für Bildung und Wissenschaft akzeptable und ausbalancierte Schrankenregelung herhalten. Für den kritischen Paragraf 53a bedeutet das, dass das Aktionsbündnis die von vielen Bibliothekaren vorgetragene und von verschiedenen Bundestagsabgeordneten unterstützte Forderung nach Erhalt des elektronischen Dokumentversands in grafischer Form (vergleiche unter anderem die Initiative der Deutschen Zentralbibliothek für Medizin) gegenwärtig als Minimalanforderung mitträgt, obgleich diese Beschränkung auf grafische Formate für Bildung und Wissenschaft eigentlich kaum erträglich ist. Dieses Recht auf Versand grafischer Dateien soll auch dann uneingeschränkt erhalten bleiben, wenn die Verlage flächendeckend mit eigenen elektronischen Angeboten auf dem Markt präsent sind. Wozu dann komplizierte Zwangslizenzregelungen unter ungewissen »angemessenen« Bedingungen?

    Abstract
    In this global information age, accessing, disseminating, and controlling information is an increasingly important aspect of human life. Often, these interests are expressed in the language of human rights-for example, rights to expression, privacy, and intellectual property. As the discipline concerned with "facilitating the effective communication of desired information between human generator and human user" (Belkin, 1975, p. 22), library and information science (LIS) has a central role in facilitating communication about human rights and ensuring the respect for human rights in information services and systems. This paper surveys the literature at the intersection of LIS and human rights. To begin, an overview of human rights conventions and an introduction to human rights theory is provided. Then the intersections between LIS and human rights are considered. Three central areas of informational human rights-communication, privacy, and intellectual property-are discussed in detail. It is argued that communication rights in particular serve as a central linchpin in the system of human rights.
