Zunächst ist damit das im Grundgesetz normierte Grundrecht der Informationsfreiheit gemeint. Dabei geht es um das Recht, sich aus allgemein zugänglichen Quellen ungehindert zu unterrichten. Für die Arbeit der Bibliotheken ist dies ein wichtiges Grundrecht, sind sie doch selbst eine allgemein zugängliche Informationsquelle. Wenn nun von einem Informationsfreiheitsgesetz die Rede ist, könnte man zunächst annehmen, hier werde das Grundrecht der Informationsfreiheit in seinen vielfältigen Ausprägungen näher geregelt. Dieses Verständnis ist indes nicht richtig. In einem Informationsfreiheitsgesetz wird nicht das Grundrecht der Informationsfreiheit umfassend normiert. Es wird vielmehr eine neue, allgemein zugängliche Informationsquelle erschlossen, nämlich die in der öffentlichen Verwaltung vorhandene Information. Ein Informationsfreiheitsgesetz gibt danach jedermann das Recht, alle in den Behörden vorhandenen Informationen zu erfahren, von gewissen (meist besonders interessanten!) Ausnahmen freilich abgesehen. Auch wenn es zunächst nicht so scheint: Für Bibliotheken ist das Thema Informationsfreiheitsgesetz (IFG) relevant. Und zwar aus zwei Gründen. Zunächst sind die Bibliotheken, die in öffentlicher Trägerschaft stehen, selbst Teil der öffentlichen Verwaltung. Sie können daher als Verwaltungsbehörden durchaus mit einem Informationsbegehren konfrontiert werden, das sich auf ein Informationsfreiheitsgesetz stützt. Dieser Fall mag relativ selten vorkommen, zumal es bei den Informationsfreiheitsgesetzen nicht um die Bestände der Bibliothek geht, sondern um deren Verwaltungswissen, also um die Akten. Hier könnte jemand erfahren wollen, wie viel Geld für bestimmte Bücher ausgegeben wurde oder welche Bücher makuliert worden sind. Solche Anfragen werden, wie gesagt, relativ selten vorkommen.

- Abstract
- Das Oberlandesgericht München hat Anfang Mai im langjährigen Rechtsstreit zwischen dem Deutschen Börsenverein und dem Dokumentenversanddienst subito sein mit Spannung erwartetes Urteil gefällt. Nach Auffassung der Münchener Richter verstößt der Service gegen das geltende Urheberrecht und darf in dieser Form nicht weitergeführt werden. Der Musterprozess hat, laut Mitteilung der Technischen Informationsbibliothek Hannover (TIB), auch Einfluss auf die Angebote anderer Dokumentlieferdienste wie Tiborder, der im Bereich von Technik und Naturwissenschaften eine führende Stellung einnimmt.

- Die Öffentlich-Rechtlichen und der VPRT dürften aber kaum angestrebt haben, Regeln für die Online-Berichterstattung von Programmzeitschriften zu definieren. Vielmehr zielten die Empfehlungen auf nicht-journalistische Program Guides: Man wollte der Entwicklung Rechnung tragen, dass es im Zuge der Digitalisierung Kabelnetzbetreibern oder Geräteherstellern möglich ist, Kunden eigene Programmübersichten zur Verfügung zu stellen. Vordergründig geht es bei dem Streit um urheberrechtliche Fragen. Jenseits davon ist die Causa interessant, weil sie wieder die Diskussion anstößt, inwieweit Medienanbieter, die sich offline nicht ins Gehege kommen, im Internet miteinander konkurrieren - etwa um Werbegelder. Wenn Sender den Online-Ablegern der TV-Zeitschriften Fotos und sonstiges Material künftig nicht mehr kostenlos zur Verfügung stellen wollen, weil letztere ihre Attraktivität bei Werbekunden erhöhen können, dann muss man das nicht grundsätzlich abwegig finden. Die Frage ist allerdings, ob die Gefahr, sich selbst zu schaden, nicht ungleich größer ist, wenn man diese Informationen nicht mehr liefert. Die Forderungen der VG Media betreffen explizit nur die Online-Verwertung, sie gelten nicht für die Printmütter der Programmblätter. Es gehe darum, "Spielregeln für die Zukunft zu definieren", schließlich werde "auf mittel- bis langfristige Sicht die digitale Nutzung von Pressematerialien deutlich wichtiger als die Print-Nutzung", sagt Geschäftsführer Hans-Henning Arnold dem Branchendienst dwdl.de. Die VG Media hält ihr Anliegen deshalb für legitim, weil auch Radiosender für die Nutzung von Urheberrechten zahlen müssen - obwohl sie zweifellos für einen Tonträger werben, wenn sie einen Song spielen.

- Abstract
- Nach Verabschiedung der EU-Richtlinie vom 22. Mai 2001 zur "Harmonisierung bestimmter Aspekte des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft" (2001/29/EG) hat das Bundesjustizministerium im März 2002 einen "Entwurf eines Gesetzes zur Regelung des Urheberrechts in der Informationsgesellschaft" vorgelegt. Dieser wurde - nach weiteren Anhörungen und Würdigung zahlreicher Stellungnahmen der betroffenen Interessengruppen - Ende Juli vom Bundeskabinett verabschiedet und als Regierungsentwurf in die Ausschüsse überwiesen. Es ist jedoch nicht mehr gelungen, das Gesetz vor Ablauf der Legislaturperiode in den Deutschen Bundestag zu bringen und nach Lesung zu beschließen. Somit muss das Gesetzgebungsverfahren nach Bundestagswahl, Regierungsbildung und Konstitution des Bundestags neu in Gang gesetzt werden. Ob es unter diesen Umständen möglich sein wird, mit dieser Gesetzesnovelle die EURichtlinie - wie gefordert - bis zum Jahresende 2002 umzusetzen, ist fraglich.
