    "Ab heute müsste kopiert und abgespeichert werden - eigentlich. Fast jede Webseite, samt Bildern, Texten und sogar Audiodateien soll die Deutsche Nationalbibliothek archivieren, im Auftrag der Bundesregierung. Das Kopieren und Abspeichern sollen die Bundes-Bibliothekare aber nicht übernehmen. Das sollen die Seitenbetreiber machen. Am Donnerstag wurde die Verordnung über die Pflichtablieferung von Medienwerken an die Deutsche Nationalbibliothek im Bundesgesetzblatt veröffentlicht - damit ist sie rechtskräftig. Auf den Seiten der Deutschen Nationalbibliothek ist auch nachzulesen, was da von nun an alles gesammelt werden soll: "Alle Darstellungen in Schrift, Bild und Ton, die in öffentlichen Netzen zugänglich gemacht werden." Mit anderen Worten: Die Nationalbibliothek möchte in regelmäßigen Abständen vollständige Kopien des deutschen Internets bekommen, einschließlich multimedialer Elemente. Ausgenommen sind lediglich "zeitlich begrenzte Vorabveröffentlichungen, reine Software- oder Anwendungstools und auch Fernseh- und Hörfunkproduktionen" Der Branchenverband Bitkom hatte schon im vergangenen Jahr gegen das Gesetz protestiert, der Widerstand verpuffte jedoch ohne Konsequenz. Deutsche Firmen werde die tatsächliche Umsetzung der Regelung 115 Millionen Euro jährlich kosten, schätzte der Verband damals. Was an Kosten auf den Steuerzahler zukommt, ist noch vollkommen unklar. Die Regelung ist das Ergebnis eines Gesetzes, das schon aus dem Jahr 2006 stammt: Dem Gesetz über die Deutsche Nationalbibliothek ( DNBG). Jetzt ist das Gesetz samt erklärender Verordnung da - aber wie das alles genau funktionieren soll, wer die riesigen Mengen Speicherplatz zur Verfügung stehen wird, das scheint noch niemand so recht zu wissen.

    Abstract
    Aufgaben der Wissensorganisation fallen in hohem Maße auch in Medienunternehmen an. Dies wird üblicherweise unter dem Terminus 'Content Management' subsumiert. Neben der internen Abwicklung der redaktionellen Produktionsprozesse ist der Datenaustausch mit externen Marktpartnern von Wichtigkeit, wie Rechteinhabern einerseits und Rezipienten bzw. Konsumenten andererseits. Zunehmend geht es dabei um die Abbildung von Rechten und die Verschlüsselung von Medieninhalten, somit von Aufgaben des Rechtemanagements. Anhand der Vermarktung aktueller Sportgroßereignisse wie Olympia 2004 und der Fußball-WM 2006 werden diese Zusammenhänge unter medienökonomischen Vorzeichen beleuchtet. Die Notwendigkeit von gesellschaftlich akzeptierten Systemen für das Digital Rights Management soll dabei herausgearbeitet werden.

    Abstract
    In der Gesetzgebungsdebatte zur Verabschiedung des Zweiten Gesetzes zur Regelung des Urheberrechts in der Informationsgesellschaft wurde bereits im Jahre 2006 ein Dritter Korb speziell für die Belange von Bildung und Wissenschaft in Aussicht gestellt. Der Bundesrat hatte ein bildungs- und wissenschaftsfreundlicheres Urheberrecht bzw. ein dezidiertes WissenschaftsUrheberrecht gefordert. Die Allianz der deutschen Wissenschaftsorganisationen hält es für dringend erforderlich, in der laufenden Legislaturperiode die Arbeit an diesen für die Wissenschaft immens wichtigen ergänzenden Regelungen zu einem Abschluss zu bringen. Sie unterbreitet deshalb dem Gesetzgeber konkrete Vorschläge für u.a. ein Zweitveröffentlichungsrecht, für verwaiste Werke und für eine allgemeine Wissenschaftsschranke.

    Abstract
    Am 11. April 2003 beschloss der Deutsche Bundestag in zweiter und dritter Lesung das Gesetz zur Änderung des Urheberrechts in der Informationsgesellschaft. Diesem ging nicht nur im Bundestag eine heiße Debatte voraus. So startete der Börsenverein einen öffentlichen Diskussionsprozess unter dem Motto "Stellen Sie sich vor, Sie schreiben ein Buch und der Staat nimmt es Ihnen einfach weg" mit dem Ziel, den neuen § 52 a UrhG und das Recht auf digitale Kopie nach § 53 UrhG zu verhindern (www.52a.de). Die Bibliotheksund informationswissenschaftlichen Verbände entgegneten mit eigenen Pressekonferenzen, Presseerklärungen und Stellungnahmen (wwwbibliotheksverband. de). Das Parlament beschloss den Gesetzesentwurf mit einigen Kompromissen im § 52 a UrhG und legte sich die Pflicht zur Evaluation zum 31. Dezember 2006 auf. Der folgende Beitrag soll allen DGI-Mitgliedern einen schnellen Überblick über die wesentlichen Neuerungen bieten und sie vertraut machen mit den beiden neuen Rechten der Urheber und anderen Leistungsschutzberechtigten: dem Recht der öffentlichen Zugänglichmachung (§ 19 a UrhG) und dem Schutz technischer Maßnahmen (§ 95 a UrhG) sowie den entsprechenden Ausnahmen und Beschränkungen im Allgemeininteresse. Zum besseren Verständnis wird auch auf bereits geltendes Recht verwiesen, soweit es elektronische Produkte und Verfahren betrifft. Die Gesetzesnovelle nimmt ausdrücklich Bezug auf digitale Netzwiedergaben und Vervielfältigungsverfahren. Bei der Anwendung von Ausnahmetatbeständen wurde erstmals zwischen wirtschaftlichem und nichtwirtschaftlichem Gebrauch unterschieden. Für Unternehmen, Firmen und Selbstständige gilt es danach, Einschränkungen zu beachten. Für alle analogen Werke und Verfahren gilt der Besitzstand, d.h. es wurden keine Veränderungen vorgenommen.
