Urheberrechtlich gesehen handelt es sich bei dieser Art von Werknutzung um Verbreiten. Das bibliothekarische Verbreitungsrecht ist eine relativ unproblematische Rechtsmaterie. Für den Praktiker reicht es im Allgemeinen zu wissen, dass urheberrechtlich geschützte Materialien, die der Bibliotheksträger im seriösen Handel gekauft hat, frei, also ohne dass eine Lizenz des Rechtsinhabers eingeholt werden müsste, ausgeliehen werden dürfen. Wesentlich schwieriger ist das Recht der Verkörperung von Werken durch Bibliotheken oder mit Hilfe von Bibliotheken, mit anderen Worten: das Recht der Bibliothekskopie. Was die Bibliothekskopie in analoger Form angeht, dürften die wichtigsten Fragen durch das drei Jahrzehnte währende Bemühen der bibliothekarischen Rechtskommissionen beantwortet sein. Auch das infolge der Urheberrechtsnovelle vom 10. September 2003 (insbesondere § 53 Absatz 2 Satz 3 Urheberrechtsgesetz) aufgetretene Problem der digitalen Bibliothekskopie dürfte mit Hilfe der den Bibliotheksjuristen seit langem bestens vertrauten Prinzipien des Vervielfältigungsrechts kurzfristig eine praktikable Lösung finden. ... Wie es bei einer Darstellung, die das Internet zum Gegenstand hat, nicht anders sein kann, ist das Handbuch, das den Rechtsstand vom Sommer 2002 wiedergibt, mittlerweile bereits in einigen Punkten überholt. - Abstract
- Informationsprozesse in allen gesellschaftlichen Bereichen schaffen bisweilen ebenso wie die Produktion und der Vertrieb von Waren und die Erbringung von Dienstleistungen eine Reihe von Konflikten, die aus der unterschiedlichen Interessenlage der daran Beteiligten oder davon Betroffenen natürlicherweise herrühren. Je mehr sich diese Interessengegensätze im Zuge des Ausbaus des Informationsmarktes und dessen verstärkter Kommerzialisierung zuspitzen und je mehr wir uns tatsächlich von einem hochindustrialisierten Gemeinwesen zu einer Informationsgesellschaft entwikkeln, um so mehr ist die Schaffung und Anwendung eines rechtlichen Regelwerkes zu deren Befriedung erforderlich. Gleiches gilt für die Bereitstellung gesellschaftlich akzeptierter rechtlicher Rahmenbedingungen, die als Strukturvorgabe für diese Informationsgesellschaft unerlässlich sind. Von Seiten der Rechtswissenschaften - aber auch des Gesetzgebers - ist dabei allerdings nach wie vor im Hinblick auf die Bereitstellung eines spezifischen Instrumentariums in manchen Bereichen ein regulatives Defizit zu verzeichnen. Sicherlich lassen sich durch einzelne Gesetzesnovellierungen punktuelle Probleme beseitigen und bei entsprechender Neukonkretisierung herkömmlicher Rechtsnormen und Rechtsinstitute diese dann auch auf Probleme des Informationswesens anwenden. Eine durchgängige praxisorientierte Vermittlung zwischen der normativen und der tatsächlichen Ebene wurde in diesem Bereich aber bisher kaum in Ansätzen erreicht. Erst recht kann bisher auch nur unter Vorbehalt von einem Recht der Informationswirtschaft oder gar, insgesamt auf die Informationsgesellschaft bezogen, von einem in sich geschlossenen dogmatisch stimmigen "Informationsrecht" gesprochen werden. Auch die zahlreichen Veranstaltungen und Publikationen, die allenthalben zu Themen wie "Multimedia-Recht", "IT-Recht", "eCommerce-Recht" etc. zu verzeichnen sind, können daran nichts ändern. Es lassen sich jedoch einige Rechtsmaterien identifizieren und spezielle Rechtsfragen verorten, denen in einem "Informationsmarkt" eine hervorragende Bedeutung zukommt und die als Grundstock für ein pragmatisch verstandenes "Informationsrecht" fungieren können. Aus Gründen der Bedeutung dieser Rechtsmaterien und der Übersichtlichkeit der folgenden Ausführungen wollen wir uns dabei hier auf drei Schwerpunkte beschränken: das Urheberrecht, das Datenschutzrecht und das Vertragsrecht. Um die Spannweite des Gesamtbereichs einschlägiger Rechtsaspekte aufzuzeigen, seien aber zuvor kurz noch einige Problemfelder erwähnt, denen in der Praxis der Informationswirtschaft ebenfalls eine herausgehobene Bedeutung zukommt.

- Abstract
- Nach Verabschiedung der EU-Richtlinie vom 22. Mai 2001 zur "Harmonisierung bestimmter Aspekte des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft" (2001/29/EG) hat das Bundesjustizministerium im März 2002 einen "Entwurf eines Gesetzes zur Regelung des Urheberrechts in der Informationsgesellschaft" vorgelegt. Dieser wurde - nach weiteren Anhörungen und Würdigung zahlreicher Stellungnahmen der betroffenen Interessengruppen - Ende Juli vom Bundeskabinett verabschiedet und als Regierungsentwurf in die Ausschüsse überwiesen. Es ist jedoch nicht mehr gelungen, das Gesetz vor Ablauf der Legislaturperiode in den Deutschen Bundestag zu bringen und nach Lesung zu beschließen. Somit muss das Gesetzgebungsverfahren nach Bundestagswahl, Regierungsbildung und Konstitution des Bundestags neu in Gang gesetzt werden. Ob es unter diesen Umständen möglich sein wird, mit dieser Gesetzesnovelle die EURichtlinie - wie gefordert - bis zum Jahresende 2002 umzusetzen, ist fraglich.
