    Discusses the publishing of books online on the Internet, in the USA. The issues is treated mainly in relation to trade publishers. Outlines various ways in which such publishers have so far used the Internet, for example in the publishing of the full text of works of fiction, for publishing catalogues, and for presenting authors to the public via bulletin boards or electronic conferences. Notes a number or problems which arise: copyright, payment for accessing items, advertising restrictions, and the ease with which the published unit can be tampered with when available on the Internet.     " Im Streit mit Google um Urheberrechte ist eine Gruppe von Buchautoren am Obersten US-Gericht gescheitert. Der Supreme Court lehnte es ab, die google-freundliche Entscheidung eines niederen Gerichtes zur Revision zuzulassen. In dem Fall geht es um die Online-Bibliothek "Google Books", für die der kalifornische Konzern Gerichtsunterlagen zufolge mehr als 20 Millionen Bücher digitalisiert hat. Durch das Projekt können Internet-Nutzer innerhalb der Bücher nach Stichworten suchen und die entsprechenden Textstellen lesen. Die drei zuständigen Richter entschieden einstimmig, dass in dem Fall zwar die Grenzen der Fairness ausgetestet würden, aber das Vorgehen von Google letztlich rechtens sei. Entschädigungen in Milliardenhöhe gefürchtet Die von dem Interessensverband Authors Guild angeführten Kläger sahen ihre Urheberrechte durch "Google Books" verletzt. Dazu gehörten auch prominente Künstler wie die Schriftstellerin und Dichterin Margaret Atwood. Google führte dagegen an, die Internet-Bibliothek kurbele den Bücherverkauf an, weil Leser dadurch zusätzlich auf interessante Werke aufmerksam gemacht würden. Google reagierte "dankbar" auf die Entscheidung des Supreme Court. Der Konzern hatte befürchtet, bei einer juristischen Niederlage Entschädigungen in Milliardenhöhe zahlen zu müssen."

    Abstract
    Im Gegensatz zu Großbritannien, der Schweiz und weiteren europäischen Ländern unterliegen Bücher in Deutschland einer Preisbindung, die mit einer langen Tradition verbunden ist. Sie betrifft nicht nur gedruckte Bücher, sondern seit der Gesetzesnovelle von 2016 auch E-Books sowie andere Mediengattungen. Rechtliche Grundlage ist das Buchpreisbindungsgesetz, das im Beitrag näher vorgestellt wird. Der Text gibt einen Überblick über die wichtigsten Regelungen zur Buchpreisbindung, die für angehende Bibliothekar*innen und Buchexpert*innen in ihrem späteren Berufsleben von Relevanz sind. Auch wichtige Gerichtsurteile und aktuelle Entwicklungen wie die Debatte um das Gutachten der Monopolkommission werden dabei in den Blick genommen.

    Abstract
    Längst hat die Informationsgesellschaft auch in die Bibliotheken von Fachhochschulen und Universitäten Einzug gehalten. Wissenschaftler und Studierende nutzen neben herkömmlichen Werken auf Papier zunehmend die Vorzüge elektronischer Medien. Ganze Studiengänge sind online organisiert. Lehr- und Lernmaterialien werden digital aufbereitet, multimedial kombiniert und im World Wide Web und Intranets bereitgestellt und abgerufen. Digitale Nutzungen reichen von der lokalen Bereitstellung elektronischer Medien an Bibliotheksarbeitsplätzen bis hin zur länderübergreifenden Verknüpfung von Abrufmöglichkeiten von Bibliotheken. Über Hochschulnetze und das Internet erfolgen Zugriffe auf Volltextdatenbanken. Archive auf Papier werden ergänzt und teilweise ersetzt durch andere Möglichkeiten der Speicherung wie etwa auf CDROMs. Manchmal treten E-Books und elektronische Zeitschriften an die Stelle herkömmlicher Publikationen, häufig existieren beide Formen nebeneinander. Bibliotheken sehen sich seit Jahren mit der Herausforderung konfrontiert, sich den Möglichkeiten der Informationsgesellschaft anzupassen und deren Nutzung zu fördern. Neben einer Vielzahl technischer, organisatorischer, wirtschaftlicher und didaktischer Fragen bringt dieser Strukturwandel unweigerlich eine Reihe rechtlicher Probleme mit sich. Einerseits fragt sich, wie sich die neuen technischen Nutzungsmöglichkeiten in den vorhandenen Rechtsrahmen einfügen, andererseits hat die Informationsgesellschaft Änderungen des Rechtsrahmens mit erheblicher Bedeutung auch für Bibliotheken mit sich gebracht. Beide Problemkreise haben ihren Ausgangspunkt in neuen technischen Möglichkeiten.

    Abstract
    Nach Verabschiedung der EU-Richtlinie vom 22. Mai 2001 zur "Harmonisierung bestimmter Aspekte des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft" (2001/29/EG) hat das Bundesjustizministerium im März 2002 einen "Entwurf eines Gesetzes zur Regelung des Urheberrechts in der Informationsgesellschaft" vorgelegt. Dieser wurde - nach weiteren Anhörungen und Würdigung zahlreicher Stellungnahmen der betroffenen Interessengruppen - Ende Juli vom Bundeskabinett verabschiedet und als Regierungsentwurf in die Ausschüsse überwiesen. Es ist jedoch nicht mehr gelungen, das Gesetz vor Ablauf der Legislaturperiode in den Deutschen Bundestag zu bringen und nach Lesung zu beschließen. Somit muss das Gesetzgebungsverfahren nach Bundestagswahl, Regierungsbildung und Konstitution des Bundestags neu in Gang gesetzt werden. Ob es unter diesen Umständen möglich sein wird, mit dieser Gesetzesnovelle die EURichtlinie - wie gefordert - bis zum Jahresende 2002 umzusetzen, ist fraglich.
