    Die meisten Leser dieser Zeilen werden die gemeinsame Stellungnahme gelesen haben. Dennoch zu einigen »Details«. Für Bildung und Wissenschaft ist die sogenannte On-the-spot-Regelung (Einsicht elektronischer Dokumente nur an Leseplätzen innerhalb der Bibliothek) nicht praktikabel - wo ist die Diskussion um virtuelle Bibliotheken geblieben? Weiter kaum einzusehen, da selbst über den Regierungsentwurf hinausgehend: die Bindung der gleichzeitigen Anzeige von Materialien an die Anzahl der in der Bibliothek real vorhandenen Exemplare, oder die Aufgabe der Autonomie über die Preisgestaltung bei der bibliothekarischen Dokumentlieferung. Gar nicht akzeptabel: die Zustimmung zur Einführung von DRM-Techniken beim Versand von grafischen Dateien - wozu sich leider auch schon subito bereit erklärt hatte; das Führen und Weitergeben von Statistiken und manches andere. Dass es schwierig ist, alle diese Restriktionen im Gesetz zu beseitigen, mag sein, aber warum machen Bibliothekarsvertreter bei Vereinbarungen mit, die nur auf vertragliche Regelungen außerhalb des Urheberrechts abzielen? Bezüglich Paragraf 53a ist die Unterscheidung zwischen Dokumentlieferung an nicht kommerzielle Nutzer und Dokumentlieferung im innerbibliothekarischen Leihverkehr systematisch nicht einleuchtend. Und dass die Dokumentlieferung von originären elektronischen Verlagswerken im innerbibliothekarischen Leihverkehr beim Endnutzer nur in Papierform enden darf, ist schon satireverdächtig. Was ist damit gewonnen, dass Bibliotheken sich digital austauschen dürfen, nur um dann die Dokumente für die Nutzer auszudrucken? Das ist keine nützliche Zwangslizenz, sondern ein Zwangsinstrument gegenüber den Nutzern.

    Abstract
    In this global information age, accessing, disseminating, and controlling information is an increasingly important aspect of human life. Often, these interests are expressed in the language of human rights-for example, rights to expression, privacy, and intellectual property. As the discipline concerned with "facilitating the effective communication of desired information between human generator and human user" (Belkin, 1975, p. 22), library and information science (LIS) has a central role in facilitating communication about human rights and ensuring the respect for human rights in information services and systems. This paper surveys the literature at the intersection of LIS and human rights. To begin, an overview of human rights conventions and an introduction to human rights theory is provided. Then the intersections between LIS and human rights are considered. Three central areas of informational human rights-communication, privacy, and intellectual property-are discussed in detail. It is argued that communication rights in particular serve as a central linchpin in the system of human rights.
