    "Der Versand von kopierten Artikeln aus wissenschaftlichen Fachzeitschriften per E-Mail verstößt gegen geltendes Recht - das ist die Kernaussage des vom Oberlandesgericht München verkündeten Urteils. Vorbehaltlich der Revision durch subito würde dieses Urteil die Forschung am Wissenschaftsstandort Deutschland maßgeblich verändern. Zwei Szenarien sind dabei denkbar. Szenario eins: subito und Anbieter von ähnlich agierenden Diensten wie Tiborder stellen den Dokumentenversand komplett auf den Postweg um. Für Kunden wären damit deutliche Komforteinbußen zur bisherigen elektronischen Lieferung verbunden. Die Wartezeit auf bestellte Fachartikel verlängert sich, zumal sich die Papierkopie nicht direkt am PC aufrufen lässt. Szenario zwei: Die Anbieter einigen sich mit den Verlagen über Lizenzen zur Nutzung von Fachartikeln auch auf dem elektronischen Wege. Dies würde eine deutliche Erhöhung der Preise für solche Dienste mit sich bringen. Uwe Rosemann, Direktor der TIB und der Universitätsbibliothek Hannover, sieht speziell im zweiten Szenario eine echte Gefahr für den Wissenschaftsstandort Deutschland: »Sollten die Verlage Lizenzen aushandeln, dann sicherlich zu Konditionen, die zwangsläufig zu großen Preissteigerungen für die Nutzer führen.« Besonders Wissenschaftler im akademischen Bereich und Studierende könnten sich solche Dienste dann nicht mehr leisten. Dass Universitäten und Hochschulen, die unter enormem Kostendruck stünden, weiterhin im bisherigen Rahmen auf solche Dokumentlieferdienste zugreifen könnten, sei unwahrscheinlich. Rosemann weiter: »Damit wird das Niveau der Literaturversorgung entscheidend gesenkt. Ein wesentliches Ziel der Lizenzverhandlung mit den Verlagen muss daher die Etablierung eines angemessen niedrigen Preises für akademische Kunden sein.«

    Abstract
    Der Konstanzer Informationswissenschaftler Rainer Kuhlen schaltet sich aus Los Angeles in die Debatte um das Urheberrecht ein. Kuhlen lehrt dort derzeit als Gastprofessor an der School of Information Studies der University of California. Er meldet sich zu Wort, nach eigenen Worten »durchaus kritisch (aber nicht als Schelte gemeint) gegenüber der gemeinsamen Stellungnahme', auf die sich der Börsenverein und der Deutsche Bibliotheksverband geeinigt haben und die dem Bundesministerium für Bildung und Forschung Mitte Januar zugestellt wurde«. Kuhlen weist ausdrücklich darauf hin, dass sein Text zwar Argumente des Aktionsbündnisses »Urheberrecht für Bildung und Wissenschaft« verwendet, aber er nicht offiziell abgestimmt, sondern von ihm persönlich zu vertreten ist.

    Abstract
    In this global information age, accessing, disseminating, and controlling information is an increasingly important aspect of human life. Often, these interests are expressed in the language of human rights-for example, rights to expression, privacy, and intellectual property. As the discipline concerned with "facilitating the effective communication of desired information between human generator and human user" (Belkin, 1975, p. 22), library and information science (LIS) has a central role in facilitating communication about human rights and ensuring the respect for human rights in information services and systems. This paper surveys the literature at the intersection of LIS and human rights. To begin, an overview of human rights conventions and an introduction to human rights theory is provided. Then the intersections between LIS and human rights are considered. Three central areas of informational human rights-communication, privacy, and intellectual property-are discussed in detail. It is argued that communication rights in particular serve as a central linchpin in the system of human rights.
