    Abstract
    Der Schwerpunkt dieses Beitrages liegt auf dem Design von Infrastrukturen, welche es ermöglichen sollen, private Daten kontrolliert preiszugeben und auszutauschen. Zunächst wird daran erinnert, dass rechtliche und technische Maßnahmen zum Datenschutz stets auch dazu dienen, den Austausch von Daten zu ermöglichen. Die grundlegende Herausforderung besteht darin, der sozialen und politischen Bedeutung des Privaten Rechnung zu tragen. Privatheit wird aus der Perspektive der Informationsethik dabei als ein normatives, handlungsleitendes Konzept verstanden. Als Maßstab für die Gestaltung der entsprechenden Infrastrukturen wird auf Helen Nissenbaums Konzept der "privacy as contextual integrity" zurückgegriffen, um u. a. die Ansätze der "end-to-end information accountability" und des "Privacy Identity Management for Europe"- Projektes zu diskutieren.

    Abstract
    Im ersten Teil des Beitrages wird eine kurze Zusammenfassung der Diskussion um den Schutz der Privatheit in Recht und Ethik gegeben. Der Schwerpunkt liegt dabei auf der Informationsethik. Im zweiten Teil werden einige für die Wissensorganisation relevante Beispiele für den Umgang mit personenbezogenen Daten diskutiert: u. a. Web Information Retrieval, Data Mining sowie FOAF als Beispiel für die Standardisierung von personenbezogenen Informationen.

    Abstract
    Die Aussage "Ich habe doch nichts zu verbergen" ist weit verbreitet. Sie scheint das überzeugendste Argument zu sein, um den Datenschutz zurückzudrängen. Der Widerstand gegen die Volkszählungen in den 80er Jahren ist schon lange her. Die Angst vor dem "Big Brother", dem großen dich beobachtenden Bruder, scheint wenig präsent zu sein. In Meinungsumfragen signalisieren die Menschen ihre Bereitschaft, für mehr Sicherheit vor Terrorismus und schweren Straftaten mehr Überwachung zu akzeptieren. Auch wenn es um Steuergerechtigkeit und Sozialleistungsmissbrauch geht, lassen sich Überwachungsmaßnahmen oft ohne öffentliche Debatte durchsetzen. Selbst das Datensammeln durch die Privatwirtschaft scheint die Menschen nicht zu schrecken. Im Internet offenbaren sie freizügig ihre Daten. Per Kundenkarten geben sie Unternehmen die Möglichkeit, über sie präzise Konsumprofile anzulegen. Die Frage ist, ob das vom Bundesverfassungsgericht in seinem Volkszählungsurteil 1983 geschaffene Grundrecht auf informationelle Selbstbestimmung nicht mehr aktuell ist. Danach haben die Menschen das Recht, grundsätzlich selbst zu bestimmen, "wer was wann bei welcher Gelegenheit über sie weiß". Passt dieses Recht nicht mehr in die moderne Informationsgesellschaft? Damals meinte das höchste deutsche Gericht, der Mensch würden seine individuellen, v.a.. politischen Grundrechte nicht mehr frei wahrnehmen können, wenn er damit rechnet, dass er "behördlich registriert wird und dass ihm dadurch Risiken entstehen können. Ohne informationelle Selbstbestimmung würde eine "elementare Funktionsbedingung eines auf Handlungs- und Mitwirkungsfreiheit seiner Bürger begründeten freiheitlichen demokratischen Gemeinwesen" fehlen. Allen Unkenrufen zu Trotz: Die Menschen haben ihr Recht auf Privatheit und Selbstbestimmung nicht aufgegeben. Die Welt der Informationen ist undurchsichtiger und komplizierter geworden. Den Menschen wird von Staat und Wirtschaft nur selten umfassend offengelegt, was mit den eigenen Daten passiert, so dass sich viele in trügerischer Sicherheit wähnen. Welche Überwachung findet tatsächlich statt? Und welche Entwicklungen zeichnen sich ab?

    Abstract
    Unabhängig davon, wie schnell und in welchem Maße sich multimediale Produkte und Dienstleistungen durchsetzen werden, eines ist klar: die technisch vermittelte Kommunikation wird weiter zunehmen. Die Bürgerinnen und Bürger dabei vor unbefugtem Zugriff, zum Beispiel kommerzieller Auswertung der Nutzungsprofile zu schützen, ist eine Aufgabe des Datenschutzes, die dementsprechend immer wichtiger wird. Insgesamt ist der Datenschutz unverzichtbarer Beitrag zur Grundsicherung in der wie auch immer gearteten Informationsgesellschaft.     Abstract
    Mit der Einführung einer europarechtlich flankierten Geodateninfrastruktur gewinnen geobasierte Daten und Anwendungen zunehmend an Bedeutung. Auch die öffentliche Verwaltung will hieran partizipieren und ihre raumbezogenen Daten der Öffentlichkeit zur Verfügung stellen. Damit wird eine datenschutzrechtlich bisher vor allem am Beispiel des Google-Dienstes Street-View diskutierte Frage akut, ob oder wann es sich bei solchen Daten um personenbezogene Daten nach dem Datenschutzrecht handelt. Der Beitrag tritt dem Vorschlag entgegen, solche Daten aus dem Anwendungsbereich des Datenschutzrechtes herauszuinterpretieren, sondern fordert den Gesetzgeber auf eine bereichsspezifische Befugnisnorm mit korrespondierenden Schutzregelungen zu erlassen. Hierfür werden Rahmenbedingungen skizziert und eine Formulierung am Beispiel des Gesetzgebungsverfahrens in Mecklenburg-Vorpommern vorgeschlagen.
