    Abstract
    ENCES - Ein europäisches Netzwerk für Urheberrecht im Sinne von Bildung und Wissenschaft - ein Schritt in Richtung auf ein wissenschaftsfreundliches Urheberrecht in Europa Der deutsche Gesetzgeber hat bei der Anpassung des deutschen Urheberrechts an die WIPO-Verträge und die EU-Richtlinien in den Jahren 2004 und 2007 die Interessen von in Bildung und Wissenschaft beschäftigten Akteuren nicht ausreichend berücksichtigt. Da die nationale Gesetzgebung heutzutage hauptsächlich durch internationale Abkommen bestimmt wird, besteht die Notwendigkeit einer Revision der EU-Urheberrechtspolitik. Um eine internationale Debatte zu fördern und die Stimme der Wissenschaftler in ganz Europa zu stärken, initiierten die Autoren das Netzwerk ENCES, indem sie einen internationalen Workshop organisierten, der im November 2008 in Berlin stattfand. Auf diesem Workshop wurde eine paneuropäische Diskussion der Ausnahmen und Beschränkungen vom Urheberrecht für den Bereich Bildung und Wissenschaft eröffnet. ENCES muss weitermachen, um die gesteckten Ziele zu erreichen.

    Abstract
    Eine typische Darstellung der Herausforderungen der Ausdrucksfreiheit im Zusammenhang mit Suchmaschinen beginnt mit einer Diskussion der Internet-Zensur in China und in anderen Ländern, die keine Tradition der Ausdrucksfreiheit und einer freien Presse haben. Daher ist die Unterdrückung von Suchergebnissen durch globale Suchmaschinenanbieter in China gut dokumentierte und Gegenstand breiter medialer Aufrnerksamkeit. Im europäischen Kontext ist die Debatte über die Implikationen der Ausdrucksfreiheit für gesetzliche Regelungen und Politiken im Zusammenhang mit Suchmaschinen dagegen weit weniger entwickelt. Dies ist bedauerlich, denn es gibt eine Reihe von Problemen, die eine solche Debatte rechtfertigen würden. Bevor ich diese Probleme im Einzelnen behandle, erscheint es nützlich, einige Beispiele voranzustellen. In den vergangenen zwei Jahren hat der argentinische Anwalt Martin Leguizamon Gerichtsbeschlüsse erwirkt, die es über hundert Menschen ermöglichten, Suchergebnisse von Google und Yahoo entfernen zu lassen Einige der Gerichtsbeschlüsse bezogen sich auf Suchergebnisse zu öffentlichen Funktionären. Doch wenn Demokratie und Ausdrucksfreiheit irgendetwas bedeuten sollen, dann ist wohl die Möglichkeit, sich über öffentliche Funktionäre zu informieren, eine Voraussetzung dafür. Google hat deshalb seine ablehnende Haltung gegenüber den argentinischen Gesetzen öffentlich kundgetan und gegen die Gerichtsbescheide Berufung eingelegt. Interessant ist in diesem Fall, dass Google dabei auf den Schutz Bezug nimmt, den es in Europa genießt. Doch leider ist diese Bezugnahme falsch. In den meisten europäischen Ländern erhalten Suchmaschinenanbieter keinen klaren gesetzlichen Schutz gegen Forderungen, aus den Suchergebnissen entfernt zu werden, und sie kämpfen mit ähnlichen Problemen wie in Argentinien.

    Abstract
    Zum 7. Mal wird Anfang November 2012 das Internet Governance Forum (IGF) stattfinden, das die Steuerung und Entwicklung des Internets auf globaler Ebene thematisiert. In diesem Jahr wird der "Weltgipfel des Internet" in Baku, Aserbaidschan, stattfinden und Vertreter aus Politik, Privatwirtschaft, internationalen Organisationen und der Zivilgesellschaft zusammenführen. Auch der internationale Bibliotheksverband IFLA wird wie in den Vorjahren wieder dabei sein, um die bedeutende Rolle von Bibliotheken in der modernen Informationsgesellschaft in die Diskussionen einzubringen. Resultierend aus den beiden Weltgipfeln zur Informationsgesellschaft (WSIS) 2003 in Genf und 2005 in Tunis, die erstmals Themen wie Information und Kommunikation und die globale Informationsgesellschaft diskutierten, entstand das Internet Governance Forum, das 2006 formell vom Generalsekretär der Vereinten Nationen ohne eigene Entscheidungsbefugnis einberufen wurde und dessen Aufgabe es ist, eine Vielzahl von Themen des Internets wie Urheberrechtsfragen, Überwindung der digitalen Spaltung, Schutz der Privatsphäre und Freiheit der Meinungsäußerung im Netz zu diskutieren. Das Thema für die Konferenz in Baku lautet "Internet Governance for Sustainable Human, Economic and Social Development". Verschiedene Länder und Regionen der Welt, so auch Europa und u.a. USA, Dänemark, Italien, Russland, Ukraine, Finnland, Schweden, Spanien und auch Deutschland haben regionale und nationale IGF-Initiativen gegründet, um die Diskussionen der Jahrestreffen auf nationaler oder regionaler Ebene vorzubereiten. Am 7. Mai 2012 kamen in Berlin rund 80 deutsche Vertreter aus Politik, der Zivilgesellschaft, aus Verbänden und der Wirtschaft zum 4. deutschen Internet Governance Forum in Berlin zusammen, um zu dem Thema "Das Verhältnis von Internet und den Grund- und Menschenrechten" die Stichpunkte aus deutscher Sicht für die Teilnahme in Baku zusammenzutragen.

    Abstract
    Da in den nächsten Monaten zahlreiche Institutionen und Gremien der Europäischen Union über den Richtlinienvorschlag zur Harmonisierung des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft beraten werden, hat eine BDB/DBI-Arbeitsgruppe das folgende Statement formuliert und - ergänzt um weitere Unterlagen - im Juli 1998 an deutsche Mitglieder des Europa-Parlaments versandt, um die Position der deutschen Bibliotheken deutlich zu machen.     Explains the legal aspects of copyright. Under English law, copying includes electronic copying of works. Takes the example of a company wishing to store its in house cuttings library of other people's news cuttings on disc. One option is to retain the newspapers. Another is to contact the publishers, which presents enormous difficulties. The Copyright Licensing Agency at present only deals with photocopying and has no mandate from newspaper publishers to include their works in such schemes

    The nature and implications of electrocopying are summarised. After a brief review of the principles of copyright, the issue of whether electrocopying infringes copyright is debated. Publishers are aware of the threat that electrocopying poses to their business. The various options available to publishers for responding to electrocopying are summarised.     Presents a summary of a report published by the US Department of Commerce on the impact of the National Information Infrastructure (NII), the information superhgihway, on copyright laws in the USA. Explains the backgroud to the report, the aims of the NII, the role of the Information Infrastructure Task Force (IITF) set up by the Clinton administration, and the work of the Working Group on Intellectual Property Rights within the IITF. Presents the report's recommendations to the US Congress on changes to copyright laws, including clarification of the copyright owner's distribution right and amendment of library privileges to bring them into the digital age.

    Abstract
    In this global information age, accessing, disseminating, and controlling information is an increasingly important aspect of human life. Often, these interests are expressed in the language of human rights-for example, rights to expression, privacy, and intellectual property. As the discipline concerned with "facilitating the effective communication of desired information between human generator and human user" (Belkin, 1975, p. 22), library and information science (LIS) has a central role in facilitating communication about human rights and ensuring the respect for human rights in information services and systems. This paper surveys the literature at the intersection of LIS and human rights. To begin, an overview of human rights conventions and an introduction to human rights theory is provided. Then the intersections between LIS and human rights are considered. Three central areas of informational human rights-communication, privacy, and intellectual property-are discussed in detail. It is argued that communication rights in particular serve as a central linchpin in the system of human rights.

    Abstract
    Nach Verabschiedung der EU-Richtlinie vom 22. Mai 2001 zur "Harmonisierung bestimmter Aspekte des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft" (2001/29/EG) hat das Bundesjustizministerium im März 2002 einen "Entwurf eines Gesetzes zur Regelung des Urheberrechts in der Informationsgesellschaft" vorgelegt. Dieser wurde - nach weiteren Anhörungen und Würdigung zahlreicher Stellungnahmen der betroffenen Interessengruppen - Ende Juli vom Bundeskabinett verabschiedet und als Regierungsentwurf in die Ausschüsse überwiesen. Es ist jedoch nicht mehr gelungen, das Gesetz vor Ablauf der Legislaturperiode in den Deutschen Bundestag zu bringen und nach Lesung zu beschließen. Somit muss das Gesetzgebungsverfahren nach Bundestagswahl, Regierungsbildung und Konstitution des Bundestags neu in Gang gesetzt werden. Ob es unter diesen Umständen möglich sein wird, mit dieser Gesetzesnovelle die EURichtlinie - wie gefordert - bis zum Jahresende 2002 umzusetzen, ist fraglich.
