Abstract
In dem am 1. April 2003 in Kraft getretenen Jungendmedienschutzstaatsvertrag (JMStV) tauchen in § 7 Abs. 1 JMStV Suchmaschinen zum ersten Mal in einem deutschen Gesetz auf. 5 7 Abs. 1 JMStV verpflichtet die Betreiber von Suchmaschinen, einen Jugendschutzbeauftragten zu benennen. Um ihrer gesellschaftlichen Verantwortung gerecht zu werden, sollten sich die deutschen Suchmaschinenbetreiber darüber hinaus auf einen einheitlichen Verhaltenskodex einigen und sich zu dessen Einhaltung verpflichten. Eine solche Selbstverpflichtungserklärung würde den Nutzern und dem Gesetzgeber signalisieren, dass sich die Suchmaschinenbetreiber ihrer Verantwortung bewusst sind. Der Gesetzgeber kann sich in diesem Fall auf das Vorgeben des gesetzlichen Rahmens beschränken und Ressourcen einsparen. Ein solches Modell des Nebeneinanders einer Selbstregulierungsinitiative der Suchmaschinenbetreiber und einer Rahmengesetzgebung des Staates entspricht dem Modell der Ko-Regulierung, das davon ausgeht, dass sich staatliche Regulierung und Selbstregulierungsinitiativen der Industrie nicht gegenseitig ausschließen, sondern ergänzen.
