- Abstract
- Noch Ende der 80er Jahre galt für Wissenschaftler, Wirtschafts- und Verwaltungsfachleute abgesichts weniger verfügbarer CD-ROM Datenbanken die Devise, lediglich einen einzigen PC innerhalb der organisation mit einem einzigen CD-ROM Laufwerk auszurüsten, auf dem dann die ein oder allenfalls zwei einschlägigen CD-ROM Anwendungen installiert wurden. Da die wenigsten Kolleginnen und Kollegen einen PC auf dem Schreibtisch hatten, wurde der Aufstellungsort des CD-ROM Laufwerks nur selten als problematisch empfunden. Anfang 1993 hat sich das Bild grundlegend gewandelt. Bildschirmarbeitsplätze gehören zum beruflichen Alltag. In etlichen Fachgebieten gibt es Dutzende CD-ROM Datenbanken, die für gezielte Recherchen nützlich sind. Nicht selten fungieren die einstigen Pilotanwender als disc jockeys, die für sich (und die Kollegenschaft) immer wieder andere CD-ROM Anwendungen in das Einzellaufwerk einlegen müssen. In dieser Situation wird immer häufiger der Wunsch, die CD-ROM in ein PC-Netzwerk einzubinden, artikuliert. Und schon gibt es Lizenzprobleme

- Abstract
- In der Dokumentationspraxis gibt es noch Unsicherheiten über die rechtliche Situation der Abstract-Erstellung. Zum einen betrifft dies die Frage, in welchem Maße Abstracts von Dritten für eigene Zwecke übernommen werden dürfen, d.h. inwieweit von Originalarbeiten eigene Abstracts erstellt werden müssen. Zum anderen braucht der Abstract-Autor selbst einen rechtlichen Schutz seiner persönlichen intellektuellen und ökonomischen Leistung, die sich im Abstract widerspiegelt. Solche Fragen werden in diesem beitrag erörtert, wobei das Hauptinteresse den Regelungen zum Urheberrecht gilt. Auf Grund ihrer Bedeutung werden das Wettbewerbs- und Vertragsgesetz ebenso behandelt wie die geplante EU-Richtlinie für den Schutz von Datenbanken

- Abstract
- Nach Verabschiedung der EU-Richtlinie vom 22. Mai 2001 zur "Harmonisierung bestimmter Aspekte des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft" (2001/29/EG) hat das Bundesjustizministerium im März 2002 einen "Entwurf eines Gesetzes zur Regelung des Urheberrechts in der Informationsgesellschaft" vorgelegt. Dieser wurde - nach weiteren Anhörungen und Würdigung zahlreicher Stellungnahmen der betroffenen Interessengruppen - Ende Juli vom Bundeskabinett verabschiedet und als Regierungsentwurf in die Ausschüsse überwiesen. Es ist jedoch nicht mehr gelungen, das Gesetz vor Ablauf der Legislaturperiode in den Deutschen Bundestag zu bringen und nach Lesung zu beschließen. Somit muss das Gesetzgebungsverfahren nach Bundestagswahl, Regierungsbildung und Konstitution des Bundestags neu in Gang gesetzt werden. Ob es unter diesen Umständen möglich sein wird, mit dieser Gesetzesnovelle die EURichtlinie - wie gefordert - bis zum Jahresende 2002 umzusetzen, ist fraglich.
