    Abstract
    Library managers are often concerned to assess the most cost effective means of access to bibliographic data. Considers comparative prices for bibliographic data on CD-ROM and in print form. In many instances, CD-ROM offers added value and easier access to data, but the relative cost is important. Library managers need not only to compare prices but to consider cost effectiveness. Differences between the nature of bibliographic data on CD-ROM and in a printed bibliography or in abstracting and indexing service, and the relative complexities of pricing structures for bibliographic data in both CD-ROM and printed form, where both hinder comparisons. Varying policies on network pricing are an added complication when assessing CD-ROM service. Concludes that some standardization of aspects of the licensing arrangements would be welcome

    Abstract
    CD-ROM technology for both storage and distribution of information has fueled the demand for network access to CD-ROMs. The many software products offer such access with a variety of features: low cost: ease of management; levels of security; performance; and network system support. Offers advice on enumerating the different solutions, assigning priorities to the issues involved and matching these priorities with the products that best serve each one. Issues considered include: throughput; security; accessing CD-ROM contents; NLM or dedicated server; ease of installation; training required; access and security control; maximum number of CD-ROM disc drives supported; drive locking; MSCDEX support; and license metering. Gleiches gilt auch für Werke aus Buchverlagen: "Nicht nur Bücher, sondern auch durch Rechtemanagementsysteme geschützte CD-ROMs oder eBooks dürfen von Der Deutschen Bibliothek nun zur Weitergabe an Berechtigte vervielfältigt werden", erklärt Wulf D. von Lucius, Vorsitzender des Urheberrechtsausschusses des Börsenvereins des Deutschen Buchhandels. Musikwirtschaft und Buchbranche haben zu diesem Zweck eine Vereinbarung mit Der Deutschen Bibliothek getroffen. Hiermit sind die berechtigten Interessen Der Deutschen Bibliothek und einzelner Nutzer, aber auch die Interessen der Rechteinhaber und Verwerter gesichert. Der Verbreitung von Kopien wird zunehmend mit Kopierschutz- und Digital Rights Management Systemen begegnet. Von dem im Urheberrechtsgesetz festgesetzten Verbot der Umgehung solcher technischer Schutzmaßnahmen ist auch Die Deutsche Bibliothek in ihrem Sammel-, Bereitstellungs- und Archivierungsauftrag als Nationalbibliothek betroffen. Um eine Langzeitarchivierung der von der Nationalbibliothek zu sammelnden Veröffentlichungen gewährleisten zu können, müssen die Medien in regelmäßigen Abständen an die aktuellen Datenformate, Betriebssysteme und Datenträger angepasst werden. Das Urheberrechtsgesetz sieht so genannte Schrankenregelungen vor, nach denen der Zugang zu urheberrechtlich geschützten Werken zu bestimmten Zwecken, wie zum Beispiel für wissenschaftliche und kulturelle Nutzungen, zulässig ist. Die letzte Novelle des Gesetzes, deren einschlägige Regelungen im September 2004 in Kraft getreten sind, sieht hierfür ausdrücklich die Möglichkeit von Vereinbarungen zwischen Verbänden vor, um diese Nutzungen auch von kopiergeschützten Medien zu ermöglichen. Als erste Branchen haben nun die Musikwirtschaft und die Buchbranche diese Möglichkeit genutzt und mit Der Deutschen Bibliothek eine vertragliche Vereinbarung geschlossen. "Die jetzt geschlossene Vereinbarung erlaubt Der Deutschen Bibliothek eine rationelle Erfüllung ihres gesetzlichen Auftrages und schafft Klarheit für den Umgang mit geschützten Medien wie Tonträgern und CD-ROMs im Verhältnis zu den Nutzern der Einrichtungen. Damit wird Rechtssicherheit für die Arbeit Der Deutschen Bibliothek geschaffen.", erklärt Elisabeth Niggemann, Generaldirektorin Der Deutschen Bibliothek. Nach der geschlossenen Vereinbarung darf Die Deutsche Bibliothek Vervielfältigungen für die eigene Archivierung, für den wissenschaftlichen Gebrauch von Nutzern, für Sammlungen für den Schul- oder Unterrichtsgebrauch, für Unterricht und Forschung sowie von vergriffenen Werken anfertigen.     Abstract
    Noch Ende der 80er Jahre galt für Wissenschaftler, Wirtschafts- und Verwaltungsfachleute abgesichts weniger verfügbarer CD-ROM Datenbanken die Devise, lediglich einen einzigen PC innerhalb der organisation mit einem einzigen CD-ROM Laufwerk auszurüsten, auf dem dann die ein oder allenfalls zwei einschlägigen CD-ROM Anwendungen installiert wurden. Da die wenigsten Kolleginnen und Kollegen einen PC auf dem Schreibtisch hatten, wurde der Aufstellungsort des CD-ROM Laufwerks nur selten als problematisch empfunden. Anfang 1993 hat sich das Bild grundlegend gewandelt. Bildschirmarbeitsplätze gehören zum beruflichen Alltag. In etlichen Fachgebieten gibt es Dutzende CD-ROM Datenbanken, die für gezielte Recherchen nützlich sind. Nicht selten fungieren die einstigen Pilotanwender als disc jockeys, die für sich (und die Kollegenschaft) immer wieder andere CD-ROM Anwendungen in das Einzellaufwerk einlegen müssen.     Explores the intellectual property issues that arise in connection with the production and distribution of multimedia products, focusing on recent efforts by a major US art museum to prepare a CD-ROM edition of its collection and catalogue. Issues discussed include: copyright interests and moral rights of artists and others whose works were to be included in the product; respective rights of the museum and the various expert contractors employed in the production process; and the ability of the museum to use copyright, patent and licensing law to protect the finished product against unauthorized exploitation.     "Vermutlich sind es Millionen Menschen, die täglich Verbotenes tun - die den Kopierschutz einer gekauften CD oder DVD überlisten, um eine Kopie für private Zwecke anzufertigen. Das Problem hat nun das oberste Gericht in Deutschland erreicht, das Bundesverfassungsgericht in Karlsruhe: In einem interessanten Urteil verdeutlicht es die Rechtslage: Die weit verbreitete Praxis ist zwar verboten, aber nicht strafbar. Anlass für die Kammerentscheidung - die das Gericht übrigens nicht wie sonst als Pressemitteilung veröffentlichte, sondern nur auf Anfrage herausgab - war eine Verfassungsbeschwerde von Herrn P. Er stellte dar, er kaufe durchschnittlich 25 CD und etwa 20 DVD im Jahr. Bis zum Inkrafttreten des geänderten Urheberrechts habe er davon regelmäßig digitale Kopie angefertigt. Zur Sicherheit, sagt er, damit Musik und Filme bei Beschädigungen nichtverloren seien. Nach dem aktuellen Urheberrecht vom September 2003 darf er das zwar weiter; Kopien zum privaten Gebrauch bleiben erlaubt. Aber er darf einen vorhandenen Kopierschutz nicht entfernen - auch nicht zur Herstellung eines Duplikats zum Privatgebrauch. Damit ist das, was eigentlich erlaubt ist, faktisch doch verboten. Denn, so Herr P., 80 Prozent der Datenträger seien mit einem Schutzmechanismus ausgestattet. Dass er folglich von den meisten seiner gekauften CD und DVD keine Privatkopie mehr anfertigen könne, verstoße gegen sein Eigentumsrecht. Das Verbot der Kopierschutzentfernung sei folglich in jenen Fällen verfassungswidrig, in denen es um rein private Kopien gehe: übrigens tat der deutsche Gesetzgeber mehr als die europäische Richtlinie verlangte. Brüssel sah vor, dass die Entfernung des Kopierschutzes zur Herstellung rein privater Abzüge gestattet werden kann. Der deutsche Gesetzgeber verbot aber auch das.

    Abstract
    Kern der Arbeit ist die Frage, inwieweit elektronische Printmedien urheberrechtlichen Schutz genießen und wo die Grenzen der Priveligierungstatbestände der §§ 49,53 UrhG verlaufen. Die Probleme sind aktuell, weil große Verlagshäuser ihre Produkte zunehmend offensiv of CD-ROMs oder im Internet anbieten. Die u.a. daraus resultierenden Herausforderungen an das tradierte urheberrechtliche System sind beachtlich. Auftretende Konflikte zwischen dem Schutz geistigen Eigentums und den Interessen der Allgemeinheit an einem freien Informationszugriff sucht die Arbeit durch ein Balancemodell zu lösen, das aus Art.5 GG abgeleitet wird. Anmerkungen zum flankierenden wettbewerbsrechtlichen Leistungsschutz und zum internationalen Rechtsrahmen ergänzen die Ausführungen
