Abstract: Die Auseinandersetzung um die Verankerung eines Zweitveröffentlichungsrechts im Urheberrecht wird aus den unterschiedlichen Perspektiven der beteiligten Akteure diskutiert. Komplexer wird das Problem dadurch, dass das Zweitveröffentlichungsrecht als Mittel der indirekten oder direkten Begünstigung des Open-Access-Paradigmas gesehen wird. Zwar soll das Zweitveröffentlichungsrecht in erster Linie die informationelle Selbstbestimmung der Autoren fördern. Als Zweitveröffentlichungsverpflichtung zugunsten von Open-Access-Repositories soll jedoch auch dem Interesse der Öffentlichkeit an einem freien Zugriff zu dem mit öffentlichen Mitteln erstelltem Wissen Rechnung getragen werden. Das wird zumindest in Deutschland als Eingriff in Wissenschaftsfreiheit für problematisch gehalten. Wissenschaftsfreiheit hängt jedoch nicht von einer positiven Publikationsfreiheit bei der Zweitveröffentlichung ab. Ein Zweitveröffentlichungsrecht (der Autoren und der sie tragenden Institutionen) könnte als Übergang zu einer vollständig durch das Open-Access-Paradigma bestimmten Wissenschaftskommunikation angesehen werden.

Abstract

Explores some of the practical difficulties associated with the management information as a commodity, and sketches a framework in which to address the problem in the context of electronic publishing. The strategy is based on the integration of 2 groups of technologies, collectively refereed to as 'secure SGML' which merges the platform-independent data representation offered by the Standard Generalized Markup Language (SGML) and related standards with the privacy and authentication functions offered by recent advances in key cryptography. This scheme allows implementation of a licensing strategy, thereby providing a means of addressing problematic copyright and public policy issues associated with digital media. Abstract

1. Problemstellung Universitätsbibliotheken sind öffentliche wissenschaftliche Bibliotheken. Sie stehen nach Maßgabe ihrer Benutzungsordnung zwar allen interessierten Bürgern offen, sind aber in besonderer Weise Forschung und Lehre ihrer Hochschule verpflichtet. Das äußert sich in partnerschaftlicher Zusammenarbeit zwischen Bibliothek und Wissenschaftlern bei der Erwerbung von Büchern oder bei der Durchführung von Schulungsveranstaltungen. Wird der Wissenschaftler aber als säumiger Leser auffällig oder hat er gar einen Schadensfall am Bibliotheksgut verursacht, kann diese Situation für beide Seiten mitunter sehr unangenehm werden. Nicht immer ist klar, ob und in welcher Höhe Schadensersatz zu leisten ist. Im vorliegenden Beitrag soll es um das Problem der Haftung für Verlust oder Beschädigung von Büchern und anderem Bibliotheksgut durch Angehörige des wissenschaftlichen Personals der Hochschule gehen.

Abstract

In den letzten Jahrzehnten ließ sich eine zunehmende Verbesserung der Kopiertechnik beobachten. Während analoge Kopien noch Qualitätsunterschiede zum Original aufwiesen, sind digitale Kopien und digitales Original ununterscheidbar geworden. Mitte der 1990er Jahre wurde diese Entwicklung erstmals zu einem ernsten Problem für die Musikindustrie. Zu diesem Zeitpunkt wurden die CDBrenner für Endverbraucher erschwinglich. Ende der 1990er Jahre erfuhren außerdem die so genannten Internet Tauschbörsen immer stärkeren Zulauf, da Internet-Benutzer dort kostenlos Dateien von der Festplatte anderer Benutzer kopieren können. Meist handelt es sich dabei um urheberrechtlich geschützte Musik, Filme oder Software. Dies führte zu einem immensen Anstieg privater Vervielfältigungen. Gleichzeitig geht der Bedarf an gewerblich hergestellten Kopien stärker zurück. Damit verlagert sich insgesamt der Schwerpunkt des Vervielfältigungsvorgangs aus dem gewerblichen in den dezentralen privaten Sektor.

Abstract

Management of rights in electronic resources on the Internet is a complex issue. this can be considered almost universal knowledge, as paraphrases of this statement can be found in many discussions on this subject. This being the case, it is not surprising that a definition, operational solution to the problem has yet to be found. In one of the world's leading metadata initiatives, the Dublin Core Metadata Initiative, discussions on this topic over several years have failed to reach a conclusion. Some people think the issue is simply too complex to handle, others that the provision of simple shortcuts to more detailed information should be sufficient. It could be argued that a solution to the issue is in fact out of scope for the Dublin Core element set, in so far as it aims only to establish a core set of descriptive metadata for resource discovery
