- Abstract
- Autoren, Verleger, Buchhändler, die Verwertungsgesellschaften und die Bibliothekare haben in den letzten Jahrzehnten den Schutz des geistigen Eigentums und das Recht der Öffentlichkeit auf ungehinderten Zugang zu Wissen und Information als gemeinsame Aufgabe erkannt und verteidigt. Die elektronischen Medien, Online- und Offline-Datentransfer, die neuen Kombinationen des Publizierens, Distributierens und Rezipierens von Wissen und Information stellen sie nun vor die Aufgabe, eine neue Balance der speziellen Interessen jedes Partners zu finden. Die BDB legt in dieser Denkschrift die Aufgaben- und Interessenlage des deutschen Bibliothekswesen vor. Erarbeitet wurde sie von Experten aus der Rechtskommission des Deutschen Bibliotheksinstituts

- Da in den nächsten Monaten zahlreiche Institutionen und Gremien der Europäischen Union über den Richtlinienvorschlag zur Harmonisierung des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft beraten werden, hat eine BDB/DBI-Arbeitsgruppe das folgende Statement formuliert und - ergänzt um weitere Unterlagen - im Juli 1998 an deutsche Mitglieder des Europa-Parlaments versandt, um die Position der deutschen Bibliotheken deutlich zu machen. - Abstract
- In der Dokumentationspraxis gibt es noch Unsicherheiten über die rechtliche Situation der Abstract-Erstellung. Zum einen betrifft dies die Frage, in welchem Maße Abstracts von Dritten für eigene Zwecke übernommen werden dürfen, d.h. inwieweit von Originalarbeiten eigene Abstracts erstellt werden müssen. Zum anderen braucht der Abstract-Autor selbst einen rechtlichen Schutz seiner persönlichen intellektuellen und ökonomischen Leistung, die sich im Abstract widerspiegelt. Solche Fragen werden in diesem beitrag erörtert, wobei das Hauptinteresse den Regelungen zum Urheberrecht gilt. Auf Grund ihrer Bedeutung werden das Wettbewerbs- und Vertragsgesetz ebenso behandelt wie die geplante EU-Richtlinie für den Schutz von Datenbanken

- Am 1. Juli 1998 beginnt Die Deutsche Bibliothek im Vorgriff auf die Novellierung des neuen Gesetzes mit der Sammlung von Netzpublikationen. In den ersten Monaten werden vor allem Dissertationen und Habilitationen sowie die Veröffentlichungen einiger freiwilliger Verlage gesammelt. Die Ablieferung der Publikationen muß in einem der von Der Deutschen Bibliothek bevorzugten Dateiformate erfolgen. - Abstract
- Im Zeitalter der Globalisierung sind die Menschenrechte zunehmend Eingriffen durch transnationale Unternehmen ausgesettzt. Das gilt auch für die Informationsfreiheit. Wenn Medienkonzerne immer weiter fusionieren, kann dieser Freiheit Gefahr drohen, insbesondere durch einen Verlust an Informationsvielfalt. Daß es erste Tendenzen zu einer globalen Medienkonzentration gibt, wird im empirischen Teil der Arbeit festgestellt. Davon ausgehend wird untersucht, ob die internationalen Menschenrechtsinstrumente dem einzelnen ein Recht auf Information verleihen. Wie dieses Recht im entstehenden System der Globalisierung durchzusetzen wäre, wird anhand von völker-, wirtschafts- und medienrechtlichen Regelungsansätzen aufgezeigt. Im Ergebnis sind dabei vor allem die Staaten in die Pflicht zu nehmen: sie müssen zusammenarbeiten, um ihrer Rolle als Garanten der Menschenrechte gerecht zu werden

- Abstract
- Im österreichischen Urheberrecht sind die Verwertungsrechte der Urheber taxativ aufgezählt gemeinsame Basis der Rechte verbunden mit den Einschränkungen, die als die sogenannte, gesetzlichen Lizenzen bekannt sind. Die Entwicklung der neuen Medien brachte eine Veränderung in das bisherige Urheberrechtsgefüge insofeme, als sich die gewohnte Balance zwischen Urhebern und der Offentlichkeit zugunsten der Rechtsinhaber verlagert hat. Damit hat eine neu Rechtsform, die der Lizenz an Bedeutung gewonnen. Bei der Aushandlung von Lizenzverträgen stehen die Bibliotheks- Informations- und Dokumentationseinrichtungen BDI zurückgedrängt in eine schwächere Position gegenüber dem Lizenzgeber, der zumeist als Monopolist auftritt, vor de Schwierigkeit, derartige Verträge zu einem für alle Beteiligten befriedigenden Abschluß zu bringen. Beim Abschluß eines Lizenzvertrages, mit dem die Befugnis, fremde Schutzrechte zu nutzen, übertragen wird, sind verschiedene Aspekte besonders zu beachten: U.a. die Rechte und Pflichten des Lizenzgebers- und nehmers, Störungen, Abtretung, Lizenzgebühr, Geheimhaltungsklauseln und bei internationalen Verträgen insbesondere die Wahl des Rechtssystems und de Gerichtsstands sowie die Vereinbarung von Schiedstellen. Bei der Charakterisierung des Lizenzvertrages als synallagmatischen Vertrag gilt es, in Zukunft eine der Öffentlichkeit auf Zugang zu Information wahrzunehmen

- Abstract
- Noch Ende der 80er Jahre galt für Wissenschaftler, Wirtschafts- und Verwaltungsfachleute abgesichts weniger verfügbarer CD-ROM Datenbanken die Devise, lediglich einen einzigen PC innerhalb der organisation mit einem einzigen CD-ROM Laufwerk auszurüsten, auf dem dann die ein oder allenfalls zwei einschlägigen CD-ROM Anwendungen installiert wurden. Da die wenigsten Kolleginnen und Kollegen einen PC auf dem Schreibtisch hatten, wurde der Aufstellungsort des CD-ROM Laufwerks nur selten als problematisch empfunden. Anfang 1993 hat sich das Bild grundlegend gewandelt. Bildschirmarbeitsplätze gehören zum beruflichen Alltag. In etlichen Fachgebieten gibt es Dutzende CD-ROM Datenbanken, die für gezielte Recherchen nützlich sind. Nicht selten fungieren die einstigen Pilotanwender als disc jockeys, die für sich (und die Kollegenschaft) immer wieder andere CD-ROM Anwendungen in das Einzellaufwerk einlegen müssen. In dieser Situation wird immer häufiger der Wunsch, die CD-ROM in ein PC-Netzwerk einzubinden, artikuliert. Und schon gibt es Lizenzprobleme

- Die Brisanz neuer digitaler Informations- und Kommunikationstechniken liegt nicht zuletzt darin begründet, daß sie in besonderer Weise grenzüberschreitend wirken. Was unser Thema betrifft, so seien aus der Vielzahl möglicher Beispiele 2 spektakuläre 'Dauerbrenner' herausgehoben: das fast exponentiell wachsende Internet liefert Zündstoff z.B. nicht nur für Bibliothekare in ihrer Rolle als Archivare, sondern auch für Verleger und Buchhändler in ihrer Eigenschaft als Ökonomen. Verständlich erscheint daher ihre Forderung nach einem internationalen Urheberschutzrecht, begleitet von einer betriebswirtschaftlichen Gesamtüberprüfung der Informationskultur; Stichwort: personal information management
