    Abstract
    Das vorliegende Papier ist das Ergebnis eines durch das MWFK Brandenburg geförderten Projektes, das seit November 2018 unter der Leitung von Prof. Dr. jur. Ellen Euler, LL.M. an der Fachhochschule Potsdam angesiedelt ist. Ziel war und ist es, alle in das wissenschaftliche Publizieren involvierten Bereiche und Akteure aus ganz Brandenburg in ein transparentes, kollaboratives und integratives Multistakeholderprojekt einzubinden und an der Erarbeitung dieser Strategie zu beteiligen. Abschließend hat sich die Brandenburgische Landesrektorenkonferenz (BLRK), in der alle brandenburgischen Hochschulen vertreten sind, im Juli 2019 mit der vorliegenden Strategie befasst. Alle Institutionen, die aktiv am Prozess teilhaben wollten, insbesondere die Hochschuleinrichtungen im Land Brandenburg und deren Infrastruktureinrichtungen, haben Vertreterinnen und Vertreter benannt, welche die Interessen und Bedürfnisse des jeweiligen Bereiches wahrnahmen und in die Strategie eingebracht haben. Durch bilaterale Gespräche, Vernetzungstreffen, Intensivworkshops und einen abschließenden Book Sprint, bei dem Expertinnen und Experten aus Wissenschaft, Forschung, Kultur und Zivilgesellschaft wertvolle Ideen und Empfehlungen zur Formulierung einer gemeinsamen Strategie zu mehr Offenheit von Wissenschaft, Forschung und Kultur im Land Brandenburg ausgearbeitet haben, die teilweise in die vorliegende Strategie eingeflossen sind, ist ein festes Netzwerk entstanden, das den weiteren Prozess über die hier vorliegende Open-Access-Strategie für wissenschaftliche Publikationen hinaus begleiten wird. Open Access als Querschnittsaufgabe bedarf gemeinsamer und koordinierter Anstrengungen auf allen Ebenen. Die vorliegende Open-Access-Strategie definiert Ziele für das Land Brandenburg und die von den relevanten Akteuren (Wissenschaftlerinnen und Wissenschaftler, Hochschulen, Infrastruktureinrichtungen und Landesregierung) umzusetzenden Maßnahmen, die zur Zielerreichung beitragen sollen, ebenso wie die notwendigen Maßnahmen zur Nachverfolgung der Zielerreichung. Das Wissen aus dem Land Brandenburg soll so verstärkt sichtbar, auffindbar, zugänglich und nutzbar gemacht werden. Der Wissenschaftsstandort Brandenburg wird damit attraktiver und die Innovationsfähigkeit der Region und der wissensbasierten Unternehmen des Landes Brandenburg wird gestärkt.

    Abstract
    Wissenstransfer erweist sich für Hochschulen und Universitäten als Schlüsselfaktor und steht in unmittelbarem Zusammenhang mit der wissenschaftlichen Informationsversorgung. Die traditionelle (papiergebundene) Publikationspraxis kann die digitale Wissensversorgung erheblich beeinträchtigen, weil sie auf einer Wertschöpfungskette beruht, der Produktionsverfahren für gedruckte Publikationen zugrunde liegen. Dies hat eine Rollenverteilung in der Wertschöpfungskette zur Folge, durch die Autoren ihre Verbreitungs- und Verwertungsrechte (als Bestandteile ihres Urheberrechts) an Verlage abtreten, die den Herstellungs- und Verbreitungsprozess für Monographien und Zeitschriften übernehmen und damit das wirtschaftliche Risiko für den Verkauf dieser Produkte tragen. Mit dieser Rollenverteilung verbinden sich vor allem dann gute Voraussetzungen für Gewinn- und Umsatzmaximierung durch Preissteigerungen, wenn das Produktport-folio einen marktbeherrschenden Monopolcharakter hat. Insbesondere bei Zeitschriften der naturwissenschaftlichen, technologieorientierten und medizinischen Fachgebiete hat sich diese Entwicklung seit langem eingestellt. Die Folge ist ein - aufgrund hoher Abonnementkosten - eingeschränkter Zugang sowie ein fast ausschließlich kommerziell getriebenes Distributions- und Marktverhalten.

    Abstract
    In der Gesetzgebungsdebatte zur Verabschiedung des Zweiten Gesetzes zur Regelung des Urheberrechts in der Informationsgesellschaft wurde bereits im Jahre 2006 ein Dritter Korb speziell für die Belange von Bildung und Wissenschaft in Aussicht gestellt. Der Bundesrat hatte ein bildungs- und wissenschaftsfreundlicheres Urheberrecht bzw. ein dezidiertes WissenschaftsUrheberrecht gefordert. Die Allianz der deutschen Wissenschaftsorganisationen hält es für dringend erforderlich, in der laufenden Legislaturperiode die Arbeit an diesen für die Wissenschaft immens wichtigen ergänzenden Regelungen zu einem Abschluss zu bringen. Sie unterbreitet deshalb dem Gesetzgeber konkrete Vorschläge für u.a. ein Zweitveröffentlichungsrecht, für verwaiste Werke und für eine allgemeine Wissenschaftsschranke.

    Abstract
    Welchen Beitrag leistet Open Access zur Steuerung und Ökonomisierung der Wissenschaft?     Abstract
    Die Erklärungen und Positionierungen zu Open Access anfangs der 2000er Jahre waren von Umbruchstimmung, Euphorie und Idealismus getragen, eine Revolution des wissenschaftlichen Publizierens wurde vielfach vorhergesagt. Die Erwartungen an Open Access lagen auf der Hand und waren umrissen: Wissenschaftlern war an rascher Verbreitung ihrer eigenen Texte gelegen sowie an der Verfügbarkeit der Texte ihrer Kollegen, Bibliothekaren an einer Abhilfe für stark steigende Journalpreise, den Wissenschaftseinrichtungen an effizienter und freier Verbreitung ihrer Inhalte. Einzig die Position der kommerziellen Wissenschaftsverlage zu Open Access war überwiegend zögerlich bis ablehnend. Der Artikel versucht sich 15 Jahre nach dem Treffen der Budapest Open Access Initiative 2001 an einer Bilanz zum Open Access. 2016 muss festgehalten werden, dass die von den maßgeblichen Open-Access-Advokaten früherer Tage erhoffte Revolution wohl ausbleiben wird. Vielmehr scheint aktuell die Entwicklung des Open Access weitgehend von den vormals in Open-Access-Szenarien kaum erwähnten kommerziellen Verlagen angetrieben. Zwar findet sich auch Open Access in wissenschaftlicher Selbstverwaltung, dennoch bleiben die Akteure im wissenschaftlichen Publizieren bislang die gleichen wie 2001 und die schon damals bekannten Konzentrationseffekte am Publikationsmarkt setzen sich fort.

    Abstract
    Open Access kennt verschiedene Spielarten. Der grüne Open Access ist in der Regel kostenfrei, denn hier werden Nutzern bereits in wissenschaftlichen Journalen publizierte Artikel in einer Art Zweitverwertung auf Open-Access-Servern entgeltfrei bereitgestellt. Im goldenen Open Access hingegen finden sich Journale, die Artikel ohne Publikationsgebühren im Open Access veröffentlichen, und solche, die für die Veröffentlichung der Texte eine sogenannte Article Processing Charge (APC) erheben. Daneben existiert noch der hybride Open Access: Dabei werden einzelne Artikel aus Journalen, die nicht im Open Access erscheinen, gegen entsprechende Zahlungen für die entgeltfreie Verfügbarkeit freigekauft.

    " Im Streit mit Google um Urheberrechte ist eine Gruppe von Buchautoren am Obersten US-Gericht gescheitert. Der Supreme Court lehnte es ab, die google-freundliche Entscheidung eines niederen Gerichtes zur Revision zuzulassen. In dem Fall geht es um die Online-Bibliothek "Google Books", für die der kalifornische Konzern Gerichtsunterlagen zufolge mehr als 20 Millionen Bücher digitalisiert hat. Durch das Projekt können Internet-Nutzer innerhalb der Bücher nach Stichworten suchen und die entsprechenden Textstellen lesen. Die drei zuständigen Richter entschieden einstimmig, dass in dem Fall zwar die Grenzen der Fairness ausgetestet würden, aber das Vorgehen von Google letztlich rechtens sei. Entschädigungen in Milliardenhöhe gefürchtet Die von dem Interessensverband Authors Guild angeführten Kläger sahen ihre Urheberrechte durch "Google Books" verletzt. Dazu gehörten auch prominente Künstler wie die Schriftstellerin und Dichterin Margaret Atwood. Google führte dagegen an, die Internet-Bibliothek kurbele den Bücherverkauf an, weil Leser dadurch zusätzlich auf interessante Werke aufmerksam gemacht würden. Google reagierte "dankbar" auf die Entscheidung des Supreme Court. Der Konzern hatte befürchtet, bei einer juristischen Niederlage Entschädigungen in Milliardenhöhe zahlen zu müssen."
