    Abstract
    Am 1. Juli 1998 beginnt Die Deutsche Bibliothek im Vorgriff auf die Novellierung des neuen Gesetzes mit der Sammlung von Netzpublikationen. In den ersten Monaten werden vor allem Dissertationen und Habilitationen sowie die Veröffentlichungen einiger freiwilliger Verlage gesammelt. Die Ablieferung der Publikationen muß in einem der von Der Deutschen Bibliothek bevorzugten Dateiformate erfolgen. Die Formalerschließung erfolgt auf der Grundlage von RAK-NBM im PICA-ILTIS-Format; die inhaltliche Erschließung auf der Grundlage der RSWK, 3. Aufl.

    Abstract
    Da in den nächsten Monaten zahlreiche Institutionen und Gremien der Europäischen Union über den Richtlinienvorschlag zur Harmonisierung des Urheberrechts und der verwandten Schutzrechte in der Informationsgesellschaft beraten werden, hat eine BDB/DBI-Arbeitsgruppe das folgende Statement formuliert und - ergänzt um weitere Unterlagen - im Juli 1998 an deutsche Mitglieder des Europa-Parlaments versandt, um die Position der deutschen Bibliotheken deutlich zu machen.     Abstract
    Digitale Medien gefährden die Selbstbestimmung des Menschen sowohl unter datenschutz- als auch unter äußerungsrechtlichen Gesichtspunkten. Die Arbeit beschäftigt sich mit den Gewährleistungen des allgemeinen Persönlichkeitsrechts (Art.2 Abs.1 i.V.m. Art.1 Abs.1 GG) unter den Bedingungen der Informationsgesellschaft. Hierbei werden die Ausprägungen des Persönlichkeitsrechts anhand der Rechtssprechung zu Fallgruppen zusammengefaßt und den neuen Gefährdungspotentialen gegenübergestellt. Die anschließende Erörterung des gegenwärtigen Rechtsrahmens schließt die neuen Multimedia-Gesetze (MDStV und TDG) mit ein. Am Ende der Untersuchung stehen Thesen zum Schutz des Persönlichkeitsrechts in der multimedialen Welt. Ein Entscheidungsregister erhöht den praktischen Nutzwert der Arbeit

    Der Information Highway - quasi das Internet im Endausbau - transportiert beliebige Inhalte ungeachtet aller Ländergrenzen an jeden gewünschten Punkt der Erde. Diese bereitet aus juristischer Sicht enorme Probleme. Denn ab geeignetem Standort lassen sich unautorisiert mit weltweiter Wirkung urheberrechtlich geschützte Werke einspeisen, unkontrolliert bewillingungspflichtige Finanzgeschäfte tätigen, sensible Personendaten generieren oder kriminelle Taten anonym begehen.     Das Internet ist in den letzten Jahren zu einem wichtigen Faktor der Informationsindustrie geworden. Es verbindet Millionen von Menschen und Firmen auf der ganzen Welt. Gleichzeitig wird das Internet für die Verbreitung von pornographischen Inhalten mißbraucht. Online-Dienste spielen für das Wachstum des Internets eine entscheidende Rolle. Sie bieten ihren Mitgliedern neben eigenen Inhalten auch den freien Zugang zum Internet. Über 50% der Internet-Nutzer weltweit sind Mitglieder eines Online-dienstes. Mißbraucht der Nutzer einen Online-Dienst, um pädophile Inhalte zu veröffentlichen, oder lädt er pornographische Abbildungen vom Internet herunter, so stellt sich die Frage der Verantwortlichkeit der Online-Dienste als Verbreitungsmedium oder Zugangsvermittler zum Datennetz.
